
The TFR issued a decree on the termination of the criminal prosecution of a citizen of Ukraine Sergei Litvinov on charges of murders and illegal methods of warfare. A copy of the documentwas published by lawyer Viktor Parshutkin.
"The criminal prosecution of Litvinov was terminated on rehabilitating grounds - in connection with non -involvement in the alleged crimes. He was given the right to compensation for harm caused as an unlawful and unreasonable prosecution," the lawyer said. The charge of robbery from Litvinov has not yet been removed, but Parshutkin is sure that this is a matter of time. “Soon there will be no robbery,” the defender wrote .
Litvinov is 32 years old, he was born and lived all his life in the village of Kamysh Stanich-Lugansk district, located almost on the border with Russia. He graduated from seven classes, worked on a collective farm with a cattle. He never served in the army. Married, there is a 14-year-old daughter. According to his wife, "he does not know how to write or read or count money."
On August 12, 2014, Litvinov, on the advice of his wife, crossed the border to lie down for treatment in the Tarasovsky Central District Hospital in the Rostov Region: the hospital did not work on the Ukrainian side. On August 21, the FSB officers in masks stole a collective farmer from the hospital and tortured in the forest. Then he was delivered to the Rostov insulator, where the torture continued. On August 29, the hostage was accused of murders and war crimes.
The TFR of the arrest of Litvinovannounced only on October 1, 2014. Probably at this time the hostage was taken to Moscow. Two weeks later, on October 14, it became known that the arrested was sent for a psychiatric examination .
At the Center for Judicial Psychiatry. Serbian Litvinova visited the Ukrainian consul. The arrested man denied his belonging to the Dnepr battalion and complained about torture.
If initially Litvinov actively collaborated with the investigation, then in the future he announced his innocence and refused to testify. In April 2015, the Parshutkin lawyer independent of the FSB took up the hostage case.
Initially, part 2 of Article 105 (murder; deadline up to life) and part 1 of Article 356 of the Russian Criminal Code were charged with Litvinov (the use of prohibited means and methods of warfare; up to 20 years of the colony). Then the collective farmer was also charged with part 3 of article 162 (robbery; up to 12 years).
In July, Parshutkin explained the appearance of an episode about the robbery that the accusation of Litvinov in massacres in the Stanichno-Lugansk district of the Luhansk region, whose victims were supposedly 30 men, 8 women and 1 teenage girl, is falling apart. Therefore, the lawyer said, it is supposed to exclude episodes of murders from the case, and the hostage to blame for the fact that he, being in the same Stanichno-Lugansk district,, along with two unidentified Ukrainian military, as if he had abducted two retreated cars from the Rostov region Andrei Lysenko.
However, the TFR then acted differently - he did not exclude the charges of murders and war crimes from the case, replacing them with an accusation of robbery, but added a new accusation to the previous one.
