The State Duma in the first reading adopted a bill allowing to ignore decisions of the ECHR

On Monday, the State Duma adopted in the first reading a bill allowing the Constitutional Court (CC) to declare unenforceable decisions of international courts, primarily the European Court of Human Rights (ECHR), if they contradict the Russian Constitution, reports . TASS

In the explanatory note to the bill, the initiators of which were representatives of all Duma factions led by the chairman of the chamber’s specialized committee on constitutional legislation and state building, Vladimir Pligin, amendments are made to the federal constitutional law on the Constitutional Court “in pursuance of the decision of the Constitutional Court itself,” the agency reports. On July 14, the Constitutional Court decided that from now on it will decide the issue of implementation of ECHR rulings in each case individually.

The amendments imply that ECHR decisions will be enforceable only taking into account the recognition of the supremacy of the Russian Constitution.

“The draft federal constitutional law, in particular, provides that at the request of the federal executive body vested with the competence to protect the interests of the Russian Federation when considering complaints filed against the Russian Federation on the basis of an international treaty in the interstate body for the protection of human rights and freedoms, the Constitutional Court The Russian Federation resolves the issue of the possibility of executing the decision of the interstate body for the protection of human rights and freedoms,” the document says.
