Convicted in the case of “Crimean terrorists,” Afanasyev demands through the court that he be transferred to another colony and paid compensation

Convicted in the case of “Crimean terrorists,” Gennady Afanasyev and his mother Olga Afanasyeva filed a lawsuit demanding that the prisoner be transferred to a colony in a region closer to Crimea. The interests of the Afanasyevs are represented by the human rights organization “Zone of Law”.

The applicants provide options for regions where it is possible to transfer Afanasyev from IK-2 Komi: Rostov region, Voronezh region and Krasnodar region.

The lawsuit states that from Simferopol (where Afanasyev is from) to Syktyvkar, the distance along main roads is more than 2.5 thousand kilometers, and there is no direct regular rail, air or bus service between the cities. According to the Afanasyevs, when transporting a resident of Crimea to serve his sentence in Komi, Article 8 of the European Convention on Human Rights (the right to respect for his family life) was violated. In their lawsuit, the Afanasyevs demand compensation for moral damage caused by the actions of the Federal Penitentiary Service in the amount of 300 thousand rubles.

The claim regarding the transfer of Afanasyev is addressed to the Federal Penitentiary Service of Russia and the department’s administration for Komi. In terms of compensation, the claim is directed to the Ministry of Justice and the Federal Treasury Department for Komi.

In November, the Supreme Court refused to consider Afanasyev's cassation appeal against the verdict.

Ukrainian citizen Gennady Afanasyev was sentenced to seven years in a maximum security colony in December last year. In court he admitted his guilt. Later, in August of this year, speaking at a meeting in the case of director Oleg Sentsov and anti-fascist Alexander Kolchenko, Afanasyev refused to confess and also reported about Sentsov’s slander under torture.
