The State Duma approved millions of fines for Internet search engines

Today, December 22, the State Duma adopted in the third, final, reading a draft law that allows you to fine search engines in the amount of up to a million rubles for non -compliance with the court decision to remove links on the Internet for information about citizens of the Russian Federation.

According to TASS , now the “non-fulfillment by the debtor-operator of the search engine of the requirements contained in the executive document to terminate the issuance of links that allow access to information about a citizen on the Internet” is punishable by a fine of 30-50 thousand rubles for individuals, 80-100 thousand rubles for legal entities.

In case of repeated violation, fines increase to 300-500 thousand rubles for individuals and up to 800 thousand - 1 million rubles for legal entities.

The basic “Law on oblivion” was adopted by the State Duma on July 3, approved by the Federation Council on July 8 and signed by the president on July 14, 2015. He enters into force on January 1, 2016 and makes amendments to the Federal Law “On Information, Information Technologies and the Protection of Information” and Articles 29 and 402 of the Civil Procedure Code of the Russian Federation.

The law establishes that “the operator of the search engine, at the request of an individual, is obliged to stop issuing information about the sign of the site page on the Internet, allowing you to access information about the applicant distributed in violation of the legislation of the Russian Federation, which is inaccurate, as well as irrelevant, which has lost its value for an individual due to subsequent events or its actions.”

Exceptions are provided in cases where information refers to a criminal offense.

The law extends the jurisdiction of Russian courts to foreign Internet search engines if they publish advertising addressed to Russian consumers.
