The investigation and the court are actively developing practice under new articles of the Criminal Code

On December 22, another conviction in the “Swamp case” was sentenced. Ivan Nepomnya was found guilty of participating in the riots and the application of violence to a representative of the authorities. They sentenced him to two and a half years in a general regime colony. The entire period of the investigation and court hearings, Ivan was under house arrest. Many had the hope that the term would be conditional, because there is a prevailing judicial practice: if a person was not taken into custody before the trial, then even after the sentence he will remain at large.

Ivan was not hiding from the investigation. Since 2012, he managed to graduate from the institute and get a job by profession. He worked until he was chosen a measure of restraint in the form of house arrest. Pavel Chikov, the head of the Agora human rights group, wrote a commentary on the sentence on Twitter: “There was a non -remembering for 8 months under house arrest. The term is counted one to one. Total - 1 year 10 months to serve. If the appeal does not reduce (term). ”

On December 21, the Kuban activist Daria Polyudova was sentenced to two years in the colony of settlement. The case against her was opened after an unsuccessful attempt to conduct a “march for the federalization of the Kuban”, which in fact was simply a single picket. The law on fines and imprisonment for calls for separatism was signed by the president on December 30, 2014. So a new criminal article 280.1 of the Criminal Code appeared: fines or imprisonment up to three years. Polyudova became “first”. The second episode, for which Daria was judged, is a repost on social networks of someone else's call to the socialist revolution. The third episode is a critical record of the President of the Russian Federation, which Polyudova herself made in social networks. The defendant denied all the accusations and insisted that she opposed the war.

On December 7, under another new article 212.1 of the Criminal Code (repeated violation of the established procedure for the organization or holding a meeting, rally, demonstration, procession or picket), activist Ildar Dadin was sentenced to three years of imprisonment. I knew him personally. This is a simple and honest guy from the railway. After all the marches and rallies of 2012, the paths of most participants parted, and Ildar remained. He went to the courts on the “swamp” and supported the guys, went out with single pickets and demanded freedom political prisoners. He went to Kyiv to the Maidan. Once he was even detained by employees of the E -E Center at the Kiev station. He was repeatedly told that he had to leave, but he refused.

On December 8, a similar sentence should have been issued to Vladimir Ionov under the same criminal article. But he was hospitalized in intensive care and the court was postponed. On December 21, Ionov made himself felt. He secretly left for Ukraine.

The 76-year-old pensioner preferred single pickets. No one would have learned about this person if he had not been detained for standing with posters and if not for Gosha Tarevich-a freak-patriot whose associates were doused with a pensioner with a green.

Criminal article 212.1 in Russia became a direct result of events on the Maidan in Kyiv. It provides a fine of up to a million rubles or a real term of up to five years. So Ionov, Dadine and two other activists began to take shape of a new judicial practice.

Two more activists, awaiting the decision of their fate, - Irina Kalmykova and Mark Halperin.

Irina Kalmykova is 52 years old, she has three children, two adult daughters and a son, who is 14 years old. In the past, she is a successful businesswoman from Siberia, but her business was taken away, the house was burned. "New" wrote in detail about this story. In Moscow, Irina joined the “Left Front” and remained in protest after its defeat. To my question, for what a criminal case was opened on her under Art. 212.1, she replied: “In April, I went out with the poster“ The Gang Killing ”, September 6 -“ Freedom to Political Personents ”, and for the third time, September 26, was detained for a single picket without a poster. Irina had searches, the court was appointed on January 18.

Mark Halperin is 46 years old, he just has political ambitions: he tried to organize his own movement, so he constantly participated in single pickets and collected a collection of “administratives”.

In fact, I think that from a large number of activists, these people were not chosen by chance. From morning to evening, the TV sets up people against Ukraine, against those who went to Bolotnaya Square. The only problem is that the Criminal Code is not described that you can sit down at the Maidan or for the Constitution. So there is a judicial practice that allows in the future to plant anyone who needs to improve the quality of food in kindergartens.
