
The prosecutor of the annexed Crimea Natalya Poklonskaya and her two subordinates read out the indictment in the “February 26 case”, whose defendants are accused of “riots” during the demonstration of democratic forces in the last days before the seizure of the peninsula. This was reported by the correspondent of "faces" from the courtroom.
The process began on December 28, 2015 in the Supreme Court of Crimea; His college of judges, chaired by Viktor Zinkov, leads. On Friday, the second meeting was held in the case. Poklonskaya personally supports the charge in the process.
As Nikolai Polozov told the Franes, the lawyer of the main accused in the case - the deputy chairman of the Medzhlis of the Crimean Tatar people Akhtem Chiygoz - "not an indictment was read out, but in fact a reprint from the decision to attract as the accused." The indictment, the lawyer explained, includes the names of the victims, the testimonies of witnesses, etc., in the text, read out by Poklonskaya and her colleagues, there was only a "fabula of compressed form."
“Naturally, Chiygoz appears everywhere - even in the accusations that are brought to other participants in the process,” the lawyer added.
The meeting, scheduled for 10 in the morning, began with a significant delay due to unprecedented security measures taken in connection with the arrival of Poklonskaya. She appeared, accompanied by certain civilians dressed in civilian people - as the correspondent of "faces" suggests, this is the personal guard of the official.
The audience, who came to the hearing, was inspected twice: at the entrance to the court building and directly at the door of the hall.
Before the meeting, the security forces detained one of the public in the court of the Crimean Tatar journalist and blogger Zaira Akadyrov. They tried to put the journalist into the car in order to, as claimed, to be taken to the CPE, however, after he presented the documents, they took it to OP Zheleznodorozhny, located opposite the Supreme Court. There he was interviewed for 35-40 minutes, after which they released. As Akadyrov said "15 minutes", during the survey, psychological pressure was on him.
Akadyrov specified the "Center of Journalistic Investigations" that Arthur Shambazov, who introduced himself as captain of the police, the investigator of the Central Bank, was detained. It was he who ordered the riot police to put the journalist in the car. Meanwhile, earlier Shambazov appeared in the media as a senior lieutenant of the FSB. He is known as one of the security forces who in February 2015 tortured Politzek Alexander Kostenko and caused him a difficult fracture of his hand.
As follows from the publication of the publication, it believes that Shambazov moved to work from the FSB to the police. More likely, however, it seems that in reality he still works in the FSB, but for some purposes he uses a fake policeman certificate. Thus, Moscow security officials come. In particular, the FSB operative, known nicknamed Lech Smile, during a “conversation” with civil activist Pavel Kuznetsov , seemed to an employee of the CPE and demonstrated the corresponding certificate.
At the beginning of the meeting, the defense demanded to ensure the publicity of the proceedings. The halls of the Supreme Court of Crimea are very small and cannot accommodate all the spectators - especially taking into account the fact that the meetings are a significant part of the "victims", who are 83 people. In this regard, lawyers petitioned to establish the broadcast of the meeting in the neighboring hall, where, in this case, part of the public could be placed.
However, the judicial board refused. This was done after a clock break for a meeting. “Apparently, they called up with their curators,” said Polozov.
The defense also filed a petition for photo and video shooting, but its judges were also rejected. They, however, cannot be banned for audio recording, since the right to it is guaranteed part 5 of Article 241 of the Russian Code of Criminal Procedure.
Meanwhile, Twitter-broadcasting the meeting correspondent was not possible to carry out due to the lack of the Internet. It was suggested that the connection in the courtroom is diligent intentionally.
Immediately after the announcement of the indictment in the hearings, a break was announced until January 25. Then the defendants will express their attitude to the charges, after which the judicial investigation will be launched.
The day before, Polozov announced his intention to call the head of Crimea Sergei Aksenov for interrogation . At the hearing on Friday, however, it turned out that the official is already a witness from the prosecution. In this regard, the lawyer noted, since the prosecutor’s office in accordance with the Code of Criminal Procedure independently determines the procedure for submitting evidence, it is not known whether Aksenov will be called to the court personally and if so, on which day.
On February 26, 2014, the Verkhovna Rada of Crimea had clashes between participants in two rallies organized according to supporters and opponents of Euromaidan. According to the prosecution, during these clashes, "two people died, 79 were caused by bodily harm of varying severity."
There are six defendants. All of them are Crimean Tatars, participants in the rally in support of Euromaidan. Chiygoza was charged with part 1 of Article 212 of the Russian Criminal Code (organization of mass riots), which provides for 8 to 15 years of the colony. The rest of the five accused - escorter Kantemirov, Escener Emirvaliev, Ali Asanov, Mustafa Degermendi and Arsen Yunusov - was charged with part 2 of the same article (participation in riots), whose sanction is from 3 to 8 years.
All the accused (with the exception of, possibly, Arsen Yunusov, who was first mentioned among the defendants only on December 7, when the case was already sent to the court) was originally placed in jail, but Kantemirov and Emirviliev were released a few weeks after the arrest. It is known that the liberation was also offered to Asanov and Deggermendi, but in return they demanded that they testimony against Chiygoz. Both the political zyt was abandoned.
In the “February 26 case” there were two more defendants. One of them - the former operator of the Crimean Tatar television channel of the ATR, Eskender Nebiev - fully pleaded guilty and went on a deal with the prosecutor’s office, so the materials were allocated to separate production in his regard. On October 12, the judge of the illegitimate central district court of Simferopol Yuri Gulevich sentenced Nebiev to two and a half years with a conditionally test term.
The second accused, whose case was also allocated in separate production, is melted by Yunusov. On the afternoon of December 28, the judge of the same Central District Court Vitaly Mikhailov sentenced this defendant to three and a half years conditionally . At the same time, the Crimean prosecutor’s office did not report the consideration of the case in a special manner, or the recognition of the defendants of his guilt. On the other hand, the department made a remark uncharacteristic of reports on such processes: "The verdict is studied by the prosecutor's office for compliance with its law."
After the start of the large process in the case, Vladimir Leontyev, the husband of one of the dead during the clashes - Valentina Korneva, said that none of the defendants was involved in the murder . According to Leontyev, his wife was killed by participants in the Anti -Maidan rally.
