On January 19, in the Maykop City Court, hearings will begin in the case of the director of the Institute of Regional Biological Research by Valery Brinich, accused of arousing hatred (part 1 of Article 282 of the Criminal Code). The reason for the criminal prosecution of the scientist was his article “The Silence of the Yagnyat”, published on the website “For Krasnodar” - in December 2014, the court recognized it as an extremist. The article was about environmental problems associated with the activities of the pig farm in the Tekezhsky district of Adygea.

According to investigators, in September 2014, the ecologist handed over the text of the article “unidentified persons” to distribute on the Internet, and soon one of these persons on behalf of Brinich laid it on the site “For Krasnodar”. Experts found statements in the publication, negatively assessing the group of persons united by nationality (Adygians), and contributing to the humiliation of human dignity according to the grounds of nationality. Brinchi himself claims that someone edited the article by adding fragments to it, which were not in the author’s version.

"Silence of lambs"

The article describes the meetings of Brinich with the residents of the auls of the Tekezhsky district, located next to the pig farm of Kiev-Zhuraki APK CJSC. First, the ecologist and his acquaintance, the former Minister of Culture of the Republic of Kasey Khachechi, come to the aul Gabukai, from where the complaint about the stench from the fields and the indifference of the local authorities to environmental problems came. Having distributed the forms of applications for everyone to join the All -Russian Society for the Conservation of Nature (Brinchi heads its regional branch), guests go to the village of Assocolia. The author notes that they and Khacheyu warned the locals in advance about their arrival.

However, near the Assocolian House of Culture, police officers and prosecutors who came from Adygeis are waiting for them. Among the security forces, according to Brinich, are the head of the inter -municipal department of the Adygea Ministry of Internal Affairs, Ruslan Ahijak with the retinue of subordinates, the deputy of the Teacher Inter -district prosecutor and the representative of the E -E Center. The residents of the aul come to a meeting with social activists no more than 10-15 people.

The security forces reproach eco -activists for not notifying the authorities of their arrival. Brinich and Khachechyu have to explain that they do not plan public events, rather - they study public opinion in Assocolary. A conversation with the locals is underway by the police and prosecutors, an employee of the Adygea department records conversations on the recorder.

The reason for the accusation of extremism presented by Brinich was phrases from the penultimate paragraph of the article. According to the expert’s conclusion dated May 29, 2015, the Adygians in the text are characterized as “panties”, “persons who do not have their own dignity”, “lambs”. These statements say in the examination, humiliate the human dignity of people of Adyghe nationality.

On December 17, 2014, the Maykop city court recognized the article by Valery Brinich “Silence of the Yagnit” by an extremist. Recently, the ecologist asked the court to revise this decision due to newly discovered circumstances. The court accepted his application for consideration, the meeting was scheduled for January 21, 2016.

“This is not my text. I wrote about the inaction of the authorities and the unwillingness of the inhabitants to fight for their rights, that they endure such an attitude to them from unscrupulous businessmen, ”says Brinich. However, the expert who studied the features of the written speech of the ecologist under his article “Conversation with a tree”, published on the same site “For Krasnodar”, concluded that the author of “Silence of the lamb” is also Brinchi.

How the “extremist” fragment of the text was in his article, Brini, according to him, does not know. In December 2015, hewrote that he did not exclude: a file with an edited article could be thrown to his computer and a hard drive after the equipment was seized during the search. “Nobody on the spot during the search did not investigate the contents of the seized hard drives to identify the article“ Silence of the lamb ”. Although there was all the possibilities for this. I stated this in my complaint about procedural violations during a search of my house, ”the ecologist insisted.

He also did not exclude that some paragraph to the article could add an access to the admission of the site “For Krasnodar” or the personal mail of the ecologist. Brinchi noted that the materials of the criminal case did not indicate which particular text option was sent from his mailing address, and the persons who published it were not established: the case of the publication was allocated to separate proceedings, which the Adyghe investigators transferred to colleagues to Krasnodar.

“At that time, all my electronic correspondence and telephone conversations were already officially controlled by the employees of the Federal Security Service of Russia in the Republic of Adygea, and the accounting details of my working address of email were known to the special services. And they had the opportunity to send mail on my behalf from any computer, ”Brini claimed.

The case file contains a decoding of an ecologist's telephone conversation with the editor of the Zakuban newspaper Vladimir Karataev, who took place before the publication of the article. In it, Karataev suggested that Brinich remove the phrase from the article that “the company is violating Islamic principles and builds a pigkomplex in the Adyghe village,” suggesting that because of this, the ecologist can be accused of inciting religious growth. Brinchi objected: "I do not write that the Russians are pushing pork by Muslims."

The investigation believes that the record of this conversation is proof of Brinich’s guilt. According to the defendant himself, his conversation with Karataev testifies just the opposite.

“In the recording of my telephone conversation with Karataev V.I. It is not mentioned that I call the Adyghe cowards, people who have lost self -esteem that I compare the inhabitants of the auls with pigs. If in my original version of the article it was, then Karataev V.I. Be sure to indicate to me, ”the ecologist wrote.

Victim

The Brinich case was recognized as the victim in the Brinich case, the administration of the Municipal Education “Tekezhsky District”, which is represented by the head of the legal department of Ibrahim Dzhanhot. In his testimony, he said that he found an article on the Internet, and after reading it had an opinion that it negatively characterizes a group of people united on the basis of nationality - Adygians. Dzhanhot considered that the article was aimed at arousing hatred and enmity and humiliation of human dignity, and reported this to the head of the administration Azamat Khachmamuku. Having familiarized himself with the text of Brinich, he experienced no less strong indignation. From the testimony of Janhot it follows that residents of the Tekezhsky district complained about the maintenance of the article, who said that the publication humiliates their dignity, affects their rights and legitimate interests. In addition, the lawyer of the village administration found statements in the article, calling the Adygians to violence in relation to representatives of local authorities.

On September 30, 2015, the Office of the Investigative Committee of Adygea brought Brinich to the complicity of inciting hatred (part 5 of Article 33, part 1 of Article 282 of the Criminal Code). On November 16, the prosecution was retrained, removing an article on complicity: as a result, Brinich was accused of humiliating the dignity of a group of persons according to the grounds of nationality and origin, committed publicly using the Internet (part 1 of Article 282 of the Criminal Code).

On February 10, 2015, the administration of the Tekezhsky district sent an application addressed to the head of the regional department of the Investigative Committee with a request to recognize it with the victim. The administration believes that the actions of those who wrote and published the article “The Silence of the Yagnit” were harmful to the locals.

Witnesses of the prosecution

Of the five witnesses, the three were present at a meeting with Brinich in the village of Gabukai. The first, Mugdin Guchetl, played cards with friends in the park where the ecologist and former Minister of Culture came. According to Guchu, he saw both social activists for the first time. He said that Brinchi began to ask the inhabitants of the aul, whether they like the smell coming from the pork farm.

“Some residents began to answer him that the smell emanating from the pork farm is terrible, and of course, nobody likes it. After that, they (Brini and Khachech - MZ) got into their car and left, ”the witness said in the testimony of the witness.

The article was read on October 14. He noted that he categorically does not agree with its content, and considers the text to be discrediting his honor and dignity as an Adyghe and offensive to all Muslims. “He was also outraged by the call:“ So when we start shooting better, the aulcians? ”” - the text of the article mentions aphorism attributed to the French enlightener Voltaire: “God helps those battalions who shoot better.”

The testimony of the second witness - the Baiseta of Guchetl - almost literally coincide with the testimony of the first. On the day of the meeting of Brinich with the inhabitants of Gabuki, he was also in the park. He saw the ecologist for the first time, but with the former Minister of Culture he was already familiar for two years. He heard the same conversations about the smell from the pork farm, and then found on the Internet the article “Silence of the lamb”, the content of which he considered offensive to Muslims.

The third witness to Ibrahim Kat said that he was in his office when Brini and Khacheye came to him. They asked him to go out to the store at the House of Culture, where the inhabitants of the aul gathered. Kat noted that at a meeting with an ecologist, no other topics were discussed except the smell emanating from the pig farm. He got acquainted with the article “Silence of the lambs” on October 14, and also considered its content to defame the honor and dignity of the Adyghe and all Muslims.

In December 2015, Valery Brinchi published a statement addressed to the prosecutor general Yuri Chaika. Referring to the materials of his business, Brinchi wrote that on November 19, 2014, an employee of the Adyghe prosecutor’s office S.Yu. Shvetsov and an unknown employee of the Techizh Interdistrict Prosecutor's Office distributed an article “Silence of the Yagnyat” among the inhabitants of the village, in which at that time they had already found signs of extremism. Brinchi also noted that the prosecutor’s office and the FSB did not take measures to block the site “For Krasnodar” on which it was published.

Two more witnesses are the editor -in -chief of the Soviet Kuban television program, a member of the Krasnodar election commission Vyacheslav Potapov, who in 2009 launched a local site for Krasnodar, and his acquaintance Vitaly Isenko, who was responsible for the maintenance of the resource. According to their indications, there are four impersonal accounts with administration rights (Poster 1, Poster 2, Poster 3 and Poster 4) of the site. According to Isaenko, since 2009, a variety of people had access to the admin panel. At the same time, witnesses claim that Isaenko posted materials on the site only with the instructions of Potapov, and he did not publish anything himself, because he did not know how. Isenko in his testimony notes that he did not delve into the content of articles that Potapov asked to publish.

Potapov told the investigators that with the contents of the article “Silence of the lamb” it was not familiar, and did not ask Isaenko to publish it. He met Brinich in the spring of 2014 in Maykop, where the ecologist gave an interview, but since then he has not maintained relations with him. Brini personally also did not ask Potapov to publish this article. Potapov learned that her text contains signs of extremism only in December 2014 from media reports.

Isaenko also claims that he is not familiar with the content of "silence of the lamb" and did not publish it. According to him, this could do this who has the Internet and access to the administrative panel, including Brini himself. He also noted that at least 40 users were tied to the IP address of his computer.

Pig farm

The new pigkomplex appeared in the Tekezhsky district of Adygea at the end of 2008. It belongs to the agro-industrial complex "Kiev-Zhuraki". The founder of this commercial structure in his article Brinchi calls the Senator from Karachay-Cherkessia Vyacheslav Derev. Currently, the agricultural complex managers have been charged with fraud and forgery: according to the investigation, they stole more than eight million rubles from the budget.

According to the Ecological Watch in the North Caucasus, the problems caused by the work of the pig farm became noticeable back in 2011, when the first stage of production was launched at full capacity, and the company reached a performance of 65 thousand heads per year. Due to the high concentration of ammonia in the washing of the grass, the foliage on the trees was burning between the village of Red and the shevchenko farm, and in the ponds of the farm, fish died. Water and soil pollution were not the only problem; Residents of the village of Krasnoye, the Habuka and Assocolas Varutor, Hottor, began to complain about an unpleasant smell: “In some cases, especially at night, the stench was so strong that it was even impossible to dry linen on the street - it immediately acquired a characteristic aroma of pork bowel movements.”

In July 2015, the Presidential Council for Human Rights held an exit meeting in Adygea, where the issue of the pigeon complex was also considered. At the Round Table, representatives of Kiev-Zhuraki and the AgroEko company, which was responsible for the disposal of manure, which is still being taken to Laguna, claimed to be "working to solve this problem."
