The name of the Dagestan entrepreneur Kuratmagomedov became widely known in connection with the events of three years ago, when the federal media and television channels announced interethnic clashes in the village of Demyanovo, Kirov region. This conflict, in contrast to the future fate of the rural businessman, was interesting to everyone - from the “Russian liberation movement”, which several times sent to the scene of “human rights expeditions”, to the opposition politician Alexei Navalny, who dubbed the incident “a mass fight on national grounds with the participation of ethnic criminal groups and the use of weapons”.
The conflict in the village of Demyanovo, Kirov Region, who was flared up at the local Cafe "Crystal" and continued near the sawmill of Nukh Kuratmagomedov, occurred in the summer of 2012. On June 20, the son of the owner of Crystal, Azerbaijani by nationality, refused to sell alcohol to four young Demyanovites. After a short fight “one on one”, the conflict participants agreed to meet the next day. The son of the owner of the cafe called with him a Dagestan, who was his nephew to the entrepreneur Kuratmagomedov. The meeting with the locals, according to eyewitnesses, ended with the beating of the Dagestan and mutual threats.
A few days later, rumors crawled around the village that cars with armed Caucasians were traveling in Demyanovo. The climax occurred on June 22, when the sawmill, on which the Dagestanis worked, surrounded people armed with reinforcement and sticks. According to the representatives of the local diaspora themselves, these were not only the inhabitants of the Podosinovsky district, but also mercenaries who were brought to the village from other regions. On YouTube video, the sounds of shots are heard - as eyewitnesses claimed, the Dagestanis fired in the air, trying to scare away those who came to the sawmill. Three confused police officers shoot up and shoot up without taking any more action. The arrived OMON fighters manage to prevent a collision. The next night, a fire occurs in the village - the crystal cafe burns to the ground.
The version of the interethnic nature of the conflict, so beloved by the press, who came to the scene of the events, the residents of Demyanovo often prompted the correspondents - according to some of them, the pilot workers traveled from Dagestan more than ten years ago, traveled around the village on expensive cars without numbers, conducted themselves defiantly and then and then and then and then and then and then and then and then and then. After the attempt to attack the sawmill in Demyanovo, a commandant hour was introduced, several police posts were put up at the entrance to the village, and the sale of alcoholic beverages was temporarily banned, which, however, did not interfere with local residents, including working in the Ministry of Internal Affairs, pretty much to get drunk . And already this household conflict has grown into a more confrontation in scale, ”he says.
After a couple of weeks, the whites resigned the heads of the village and the district administrations, the head of the police of Demyanovo, the acting Head of the police department of the Podosinovsky district, as well as the district prosecutor. The Investigative Committee qualifies that happened in the village as mass riots. Investigators claim that on June 22, “unidentified persons” “initiated an accumulation of more than 120 residents of a village aged 20 years and older” and, distributing metal rods, wooden sticks and boards for use as weapons, as well as alcohol, organized a march into the territory of the sawmill. There, according to the investigation, unknown people tried to apply violence against the Dagestanis.
The investigation could not find the organizers of the riots - as a result, the case was closed with the wording "due to the lack of corpus delicti." Meanwhile, the lawyer of the owner of the sawmill Kuratmagomedov Saigitov claims that the local “criminal authority” provoked this conflict, whose name was known to investigators from the very beginning. “This man with Kuratmagdeov had, so to speak, a skirmish - he actually declared him in the eyes of local residents as one of the leaders of the criminal world, insulted him. Then he decided to take revenge, and turned to a local entrepreneur, who was the main competitor of Kuratmagomedov. They drove local residents and on June 22 provoked them on a trip to this sawmill. That is, there was a clear provocation - there were never even serious conflicts between local Russians and representatives of the diaspora, ”the defender claims.
The only person who was undergoing criminal prosecution after a conflict in Demyanovo was a local resident Vladimir Burakov - he was accused of hooliganism, a fabric of a cafe, an attack on a police officer and forcing an eyewitness to the Crystal to give false testimony. The witness himself claimed that the testimony was knocked out by the employees of the Kirov Center "E". Burakov spent almost a year in the pre -trial detention center for almost a year until the Podosinovsky District Court removed most of the accusations from him, leaving only an episode with an attack on a policeman, on the shield of which the accused hit a metal pipe. As a result, the court found him guilty under Part 1 of Article 318 of the Criminal Code (the use of violence in relation to a representative of the authorities, not dangerous to life or health) and sentenced to ten months in prison.

According to the brother of Nukh Kuratmagomedov Israel, the businessman himself was in Syktyvkar during the June events in Demyanovo. When rumors about the impending attack on the sawmill reached the entrepreneur, he tried to convey this to local officials, but they did not take any measures, the interlocutor of the Mediazones claims. The verdict of Burakov set an end to the story of pogroms in Demyanovo - but not for the Dagestan entrepreneur.
The arrival in the village of the regional head and the subsequent dismissal of local officials laid the foundation for the long confrontation of Kuratmagomedov with the district authorities. Soon after the clashes, the new prosecutor of the Podosinovsky district of Dolgikh, who came to the place of the dismissed, filed a lawsuit with a lawsuit to deprive the businessman of the land plot on which the sawmill was stood, and the demolition of buildings erected on it. In the document, the district prosecutor indicated that this land has been in state property, although the Dagestan sawmill functioned since the beginning of the 2000s and provided jobs about a hundred local residents.
During the consideration of the claim in court, the entrepreneur explained that he had bought this land from his fellow countryman, and asked him to give him time to draw up documents properly. However, this did not help - already in September 2012, the prosecutor’s lawsuit was satisfied. For a long time, Kuratmagomedov appealed the court decision in higher authorities, simultaneously re -registering documents for the site. According to the lawyer Saygitov, the entrepreneur spent six months on this, and legal costs amounted to about 700 thousand rubles. However, it was impossible to win the court as it turned out later, due to the submission of the Podosinovsky district submitted by the new prosecutor.
“Half of the documents were issued to him, and difficulties were created in another part - according to the prosecutor’s representation, the administration simply could not give them out. At the same time, no one notified Kuratmagomedov about this, he learned about it at the last moment - that is, a person spent a lot of time, ran, executed these documents, paid a bunch of money for them, but in the end it turned out that he could not fully draw up the right of ownership, ”says Saigitov.
In January 2013, the bailiffs department in the Podosinovsky district instituted enforcement proceedings on the forced dismantling of the buildings - a sawmill, a brick garage and a guard booth. Kuratmagomedov tried to find a way out of the situation, disputed the decision, wrote complaints and pulled time by any means.
This went on for almost a year and a half, until September 9, the entrepreneur received a notice of the demolition of buildings. And two weeks later - September 23, 2014 - Kuratmagomedov was arrested as part of the criminal case instituted against him on the same day under part 1 of Article 205 of the Criminal Code (terrorist act). The next day, the bailiffs demolished his sawmill. On October 29, 2015, the visiting board of the Moscow District Military Court, having examined the Dagestan case in Kirov, sentenced Kuratmagomedov to eight years in a maximum regime colony. According to the lawyer Saygitov, this is the first time when the Russian was convicted of an article on terrorism exclusively for words.
According to the text of the verdict, Kuratmagomedov, “using the demolition of the buildings erected by him as a pretext,“ took active actions to destabilize the activities of local authorities by expressing threats of a fabric of special equipment of the construction and installation organization (contractor company, which was supposed to be dismantled-MZ), the rejection of the law enforcement of the judicial Decisions by persons, the organization of mass riots connected to armed opposition to authorities and local residents, and the commission of other actions that frighten the population and create the danger of the death of people. ” As follows from the case file, the investigator established all this, having studied the wiretap of telephone conversations of the Dagestan, the permission for which the operatives of the Kirovsky UFSB received another four months before the initiation of the criminal case.
In total, the case file has seven entries from the businessman’s phone. Four of them are conversations with the director of the company to execute a contract with the UFSSP for the demolition of a sawmill, during which Kuratmagomedov “expressed threats to prevent the execution of a court decision by fagging equipment, causing harm to the life and health of employees and law enforcement officials”. On the two others, the entrepreneur’s conversations with the head of the bailiffs in the Podosinovsky district were facilitated - during the first Dagestan, as he established the court, “said that in the event of a building’s demolition performers, they would attract about 500 people who were ready to put armed resistance to them,” and in the second “confirmed their intention to not allow the demolition of the buildings, saying that he would be burned with equipment and shoot at the equipment and shoot at Everyone who enters the site. “The mentioned audio recordings do not give an idea of how for several years the people with whom I have aggressively communicated, mocked me, exerting psychological pressure, provoking me into conflict. With their actions, they forced me to long and repeated campaigns in instances that did not bring the desired result. These people allowed themselves to be tortured, to bring me to a state of emotional breakdown, and then use phrases expressed by me in this state in order to bring me to criminal liability for the alleged committing of a particularly serious crime, for which only odious militants and notorious killers and villains, ”he wrote from a pre -trial detention center before the announcement of the sentence. Kuratmagomedov also speaks of provocative leading issues of questions from the interlocutors: “His bailiff asked:“ If we adjust the technique, what will you do with it? ” "What will I do with her?! I will burn her!" - my brother answers. Moreover, in audio recordings you can hear how someone is joking next to the bailiff, advises him what to say in order to provoke my brother. ”
Since in a fit of rage, the Dagestan often switched to his native language, the protocols with the decoding of conversations were made with the help of a translator. However, it is impossible to confirm his competence and the level of education, since the Federal Security Service Secured his personality, says Saigite. The investigation did not conduct a phonoscopic examination, which is required for affairs based on a telephone wiretapping, the lawyer explains. “But the investigator was not too lazy to conduct a comprehensive psychological-linguistic examination of the audio recording to confirm the allegedly the seriousness of Kuratmagomedov’s intentions,” he notes.
According to this document, the Dagestan demonstrated the seriousness of his intentions, "actively using threats, persuasion and repetition." “The activity of conversations is the pronounced nature of the massive psychological pressure by Kuratmagomedov on representatives of state bodies and the business entity, the purpose of which is to encourage them to abandon the intentions of the demolition of the property belonging to him. При этом, отмечает адвокат Сайгитов, судья не включил в свой вердикт сделанный теми же экспертами вывод, согласно которому дагестанец был уверен в собственной правоте и законности своих действий.

Помимо лингвистической экспертизы, серьезность намерений Куратмагомедова, по мнению следователей ФСБ, подтвердило обнаружение на территории лесопилки трех стеклянных бутылок, «содержащих жидкость с характерным запахом легквоспламеняющихся жидкостей» и «снабженных фитилями из ткани». Поскольку никто кроме следователя этих бутылок не видел — в ходе суда изучались лишь протоколы их осмотра — адвокат Сайгитов уверен, что зажигательную смесь либо подбросили, либо бутылок не существовало вовсе.
«Одновременно с задержанием Куратмагомедова у всех его знакомых дагестанцев в Подосиновском районе прошли обыски, искали оружие, целый полк оперативников из Кирова был выписан. Но ничего не нашли, а реальность намерений как-то подтвердить надо, и тогда появляются эти бутылки. Леоспилку осматривали дважды. Вечером 23 сентября с огромным количеством людей на территории, и в семь часов утра следующего дня, когда на лесопилке никого, кроме оперативников, не было: они даже сторожа выгнали. То есть два протокола осмотра одного и того же места с использованием одной и той же собаки, но на повторном мероприятии почему-то эти бутылки находятся», — говорит он.
В поддержку Куратмагомедова в конце 2015 года высказался глава комиссии по СМИ и общественным связям постоянного представительства Дагестана при президенте РФ Юрий Атаев, а также уполномоченный по правам человека по Чечне Нурди Нухажиев. Последний обратился к исполняющему обязанности прокурора Кировской области Александру Окатьеву с просьбой оказать содействие в защите конституционных прав дагестанского предпринимателя. С той же просьбой омбудсмен обратился к главе Кировской области и руководителю областного УФСБ.
«Тут на ум приходит пословица о том, что язык мой — враг мой. Защита и родственники уверены, что все эти слова были блефом, Куратмагомедов просто не хотел лишаться своего источника доходов и таким образом пытался оттянуть время. В ходе рассмотрения апелляционной жалобы на приговор Куратмагомедову в Верховном суде Сайгитов пытался убедить коллегию, что следствие не доказало наличия в действиях предпринимателя признаков, позволяющих квалифицировать их по статье 205 УК.
«Как Куратмагомедов мог "дестабилизировать систему органов государственной власти", если решение о сносе в итоге было исполнено по графику, и для этого не понадобилось никакого усиления, если полиция в эти дни работала в штатном режиме? Как вообще мог один человек, не будучи лидером какой-то влиятельной террористической группировки, дестабилизировать работу вооруженных и защищенных органов власти? Что же это тогда за органы такие? И, наконец, как его действия могли быть направлены на "устрашение населения", если население, местные жители, вообще не знали о содержании разговоров, которые послужили основанием для вынесения приговора Куратмагомедову?» — вопрошал защитник.
Семья Куратмагомедовых по-прежнему живет в Демьяново. При этом родственникам предпринимателя, осужденного за терроризм, «создали искусственные долги», рассказывает его брат Израиль. «Нух говорит, что понятия не имеет, откуда они появились. Налоговая ошибочно взяла у него 70 тысяч рублей, потом вернула, но появились какие-то сфабрикованные долги», — жалуется собеседник «Медиазоны». Он отмечает, что у его брата остались четыре жены, шестеро своих детей и еще восемь малолетних иждивенцев. 3 июня прошлого года Израиль обратился в арбитражный суд Кировской области с просьбой признать его брата банкротом.
