
On Tuesday night in Moscow, a large -scale demolition of trading pavilions began, built, according to the authorities, without permits. According to Interfax, a law enforcement source reported this.
According to him, prefectures of a number of administrative districts of Moscow, including the central, northern, east, organized the demolition of illegally erected outlets at more than 50 city addresses in accordance with court decisions. The structures, the source emphasized, were erected arbitrarily back in the 90s of the twentieth century, and the owners and tenants were repeatedly warned that the tents would be demolished.
Demolition occurs near the metro stations "Chistye Ponds", "Taganskaya", "Shchelkovskaya", "Partizanskaya", "Sokol", on the streets of Lusinovskaya, Marxist and others, the source said. According to him, work is underway with the support of the bailiffs and the police, conflicts with the tenants of the pavilions arose at several points.
In the Albatros shopping center near the Schelkovskaya metro, several dozen store workers decided to stay in the building, as they consider the actions of the capital's authorities unreasonable. In particular, the commercial director of Albatros Alexei Voronin said that in January the arbitration court confirmed the legal status of the building. The building before demolition was disconnected from gas supply.
A similar situation arose in the pavilion on Leningradsky Prospekt, where they sell flowers, vegetables and fruits - several people were also locked there. The door to the room had to hack.
The conflict with the police arose at the pavilions on "pure ponds" - there the owners demanded that the workers come to provide documents on the basis of which demolition is carried out. At least one of the opponents of the demolition was detained.
In total, 700 units of equipment were simultaneously involved in the work on the forced dismantling of 97 objects, said Sergey Shogurov, head of the capital's State Inspectorate for Real Estate. "Most illegal structures stood directly above the underground communication lines - telephone sewage, gas pipeline, heating systems, electric networks and others," he added.
Later, on Tuesday, Moscow Mayor Sergei Sobyanin promised to "improve the places where these objects were." “The previous owners, with their desire, will provide the opportunity to build trading facilities in other places and on legally,” he added in a message posted on the VKontakte social network.
Meanwhile, the Russian Orthodox Church called a sound thought to build temples on the site of demolished stores. According to Dimitri Smirnov, chairman of the Patriarchal Commission on Family, Protection of Maternity and Childhood, the temples are crowded in the capital, and there are not enough free sites.
On December 8, 2015, the Moscow government adopted a decree "On measures to ensure the demolition of unauthorized buildings in certain territories of the city of Moscow", which provides for the demolition of 104 objects. According to the resolution, they are recognized as self-building due to improper paperwork, being on public lands or in areas with utilities. In December, all owners sent notifications of demolition.
At the same time, most owners of the objects have properly executed all the documents about the property, said Sergey Seliverstov, Executive Director of the Moscow Department of the Russian Federation. According to him, the objects were erected at the plots allocated by the city authorities in accordance with the rules and norms operating at the time of their construction.
According to Vedomosti, in some cases the dispute reached the Supreme Court, and the decisions were made not in favor of the Moscow authorities. So the Supreme Court refused to revise the decision on the lawsuit of Moscow to the owner of the Pavilion on the People’s Militia Street. The authorities lost the cassation for similar claims against the owner of the Albatros shopping complex of Shchelkovskaya, as well as claims against the owners of the pavilions at the Arbat and 1905. The court decisions show the results of the examination, which proved that disputed objects do not threaten the life and health of citizens.
