The prosecutor burned at the stake

In Tatarstan, an ordinary criminal case about the rape of two girls develops into a large corruption scandal and the war between the law enforcement agencies: the prosecutor of the Kukmorsky district Minimulla Nazipov convinced the victim and her mother to refuse to testify, the republican administration of the SK opened the case against Nazipov, but two days later he was closed by the prosecutor of the Republic Ildus Nafikov. The local press does not exclude that the alleged rapists could pay off from justice.

On May 28, 2015, a company of young people aged 20 to 30 years rested in the ski complex of the village of Kukmore, which is 115 kilometers northeast of Kazan. The men drank by the fire; One of them decided to invite his familiar to the impromptu table, who was visiting that day to friends-14-year-old Oksana and 19-year-old Marina (the names of the victims were changed at the request of a lawyer representing their interests). The girl herself refused the invitation, but her guests got into the car and went on a holiday.

“The young man himself arrived for them by car, took the two of them from the house of a friend and brought them to the place where he was resting with friends. At the same time, the teenager met the initiator of the meeting, and subsequently rape, a couple of days before the incident, and the second girl at all saw him for the first time, ”says the lawyer of Rausenia Kamalova, who collaborates with the human rights organization Zone of Law and representing the interests of the victims. According to her, when the girls were brought to the ski complex, four men remained around the fire, one of them was a former police officer.

The first victim of sexual violence that day was a minor Oksana. “The drunk young man began to push her towards the bushes, away from the company and began to undress the girl there. She says that she tried to fight him, asked to stop, but he ignored her requests - pushed to the ground, piled up and raped, ”the lawyer says. After that, the man ordered the victim to dress and brought back to the fire. The girl sat down near the fire, and her rapist began to tell friends about what had happened and offer them to have sex with a teenager. “Thus, Oksana raped three adult men that day,” says Kamalova. Later, the minor said that a man named Aidar (he was the initiator of the crime) and his friends - Ramis and Edward participated in the rape.

Soon, Aidar volunteered to take the 19-year-old Marina home. Together they went to the car parked nearby, the man put the girl in the back seat, blocked the doors and, despite the resistance, raped her. Then the young people returned to the company. “The girl was just nowhere to go. The second accused also began to offer Marina to enter into an intimate relationship. Apparently, since she is older, Marina realized how to behave - she agreed to go to the car with a man, and then ran away from him, ”explains Kamalova’s lawyer.

Marina ran to the nearest house and began to knock on the windows and doors until she was opened. The girl told the hostess about what happened; Soon the police arrived at the scene. The detained men tried to convince law enforcement agencies that the girls had sex with them by mutual agreement.

“Based on how this girl turned for help, it becomes clear that the words of the accused about voluntary sexual contacts sound, to put it mildly, unconvincing. If they knew each other before, met, and if the girls contacted the police two days after sexual contact, at least some doubts about their testimony could arise. But in this story, the girl ran and burst into an unfamiliar house, turned to strangers, shouted that she was raped. I do not think that the girls after voluntary sexual intercourse behave like that, ”the lawyer argues.

After the incident, Oksana and Marina underwent a medical examination. “It did not show any special damage, but the girls do not even say that they were beaten. Only the eldest victim claimed that the man that raped her wilted her several slaps and in the process scratched her forehead with a ring. Indeed, doctors recorded this scratch on his forehead. And the examination of a piece of fabric from the car showed that it has the blood of the victim, ”the lawyer says.

Immediately after the rape, vaginal flushes were taken from the girls, however, while the investigation was drawn, the samples became unsuitable for some examinations - as it turned out, they were stored inadequate. Studies have not been conducted yet according to blood samples.

The case of the rape of Marina (part 1 of Article 131 of the Criminal Code) and the minor Oksana (paragraph “A”, part 3 of Article 131 of the Criminal Code) was first excited on June 7 last year by the Arsky inter -district investigative department of the SK. Three men became the accused, while the former policeman was a witness in the case - he did not participate in the rape of girls, according to the victims themselves. However, already at the end of the month the decision on initiation of the case was canceled: according to the minor victim, in July last year, the prosecutor of the Kukmorsky district, Minimulla Nazipov, invited her to his office with his mother and demanded to admit false testimony.

“Nazipov called the victim and her mother through the investigator. He talked very aggressively with them, pushing that the girl herself was to blame. He very persistently recommended writing that sexual intercourse with men was voluntary. Otherwise, he said, the victim of the girl will be disgraced - the whole village will become known about what happened. The prosecutor threatened her mother, working as a teacher, ”Kamalova explains. Under the pressure of the prosecutor, Oksana wrote an explanatory and refused the data earlier.

The prosecutor also exerted pressure on the second victim - Marina - however, the girl did not take her statement. Nevertheless, the deputy head of the Army Investigative Department Richatullin, who held the post of deputy Nazapov in the past, instructed his subordinate to terminate the criminal case of rape due to the lack of crime in the actions of the accused corpus delicti.

“The true reason for the cancellation of the decision to initiate criminal proceedings may have been that one of the alleged rapists could be a relative of the driver at that time of the Kukmorsky district prosecutor,” the Kazan Reporter later suggested that the journalists could not officially confirm this information.

Only a few months later, the central apparatus of the Republican Investigative Department of the UK became interested in the rape of two girls. On January 13, 2016, a criminal case was instituted against the prosecutor of the Kukmorsky district of Nazipov on the fact of excess of official powers (part 1 of Article 286 of the Criminal Code) and the coercion of a 14-year-old victim to give false testimony (part 2 of Article 309 of the Criminal Code). At the end of January, Nazipov was fired , Richat Shakirov took the position of district prosecutor. The case of abuse of powers was also initiated against the deputy head of the Arsky Investigation Department of Samigullin.

On February 16, the Kazan Reporter said that two days after the initiation of the case against Nazipov, the prosecutor of Tatarstan Ildus Nafikov decided to close the case against his subordinate. “The prosecutor of Nazipov in the implementation of supervisory activities acted in accordance with the powers assigned to him,” the prosecutor of the republic emphasized. In a howl, he emphasized that "the arguments of the victim and her mother are not confirmed by objective data."

The document, which had at the disposal of the publication, states that on the day when both victims were raped, the girls drank alcohol “and in connection with this” the prosecutor Nazipov called Oksana and her mother to his office. The latter was later brought to administrative responsibility under the articles of the Code of Administrative Offenses 20.22 (finding a minor while intoxicated) and 3. 11 (non -compliance with the requirements to ensure measures to prevent harm to the health of children and their development).

“Based on this, it follows that the victim and her mother had a personal motive for the reservation of Nazipov,” concluded the prosecutor of Tatarstan.

However, now Nafikov is forced to make excuses for his own decision: one of the accused admitted to investigators that young people, counting on the closure of the criminal case of rape, collected money to bribe officials.

A fragment of the operational video , in which a person sitting his back to the camera speaks of the impending bribery, showed the Ren-TV channel on the air; Kamalova’s lawyer confirmed Mediazone this information.

“The prosecutor’s office as a supervisory authority is interested in an objective investigation of a criminal case of rape,” Nafikov assured. He explained that the investigation continues, "in connection with this, commenting on the course of the investigation and drawing any conclusions prematurely and unacceptable."

Now all three accused of raping girls are taken into custody. The victims to communicate with journalists are still refused - according to the lawyer, they both experience severe stress. The mother of the raped minor years sent a complaint about the decision of the prosecutor of the republic - she asks to recognize the decision of Nafikov illegal and renew the preliminary investigation. The Vakhitovsky District Court will consider her complaint on February 25.
