
The case of the Ukrainian pilot Nadezhda Savchenko cannot be transferred to the jury, since his consideration has already begun. According to Interfax, the chairman of the Constitutional Court Valery Zorkin stated this.
"If cases are already appointed with the participation of the College of Judges, they will be considered. If you are not yet appointed, then the applicant has the right to petition for the consideration of his case with the participation of the jury. If the case is already considered, as in the case of a citizen of Savchenko, it is not subject to a revision with the participation of the jury," said the chairman of the KS.
Meanwhile, the defense of Savchenko did not exclude appeals to the European Court of Human Rights. “In essence, we will no longer be able to achieve the consideration of the jury by the court, the decision of the Constitutional Court closes such a right for us. But this may become a separate subject for applying to the ECHR, we do not exclude the preparation of the corresponding complaint,” said Lawyer Marc Feigin.
He recalled that Savchenko asked the court to consider her case by a jury, but received a refusal. "We have grounds for appeal, since the court recognized the norms of criminal legislation by unconstitutional, we must study in detail," the defender said.
Earlier on Thursday, the Constitutional Court recognized the norms contrary to the law, depriving women of the right to a jury. By a court decision, the legislator must amend the Code of Criminal Procedure.
Alina Lymar, sentenced to 8 years in prison for the murder of a minor daughter, made a complaint in the Constitutional Court of the Chelyabinsk Region. The applicant asked her to consider the jury, but due to the changes made in the Code of Criminal Procedure in 2013, she was deprived of such a right.
In 2013, all cases were excluded from the jurisdiction of the federal level courts, "for which lifelong imprisonment or death penalty cannot be imposed as the most strict punishment (Article 31 of the Code of Criminal Procedure). For women, the Criminal Code directly prohibits the appointment of life imprisonment, as well as minors and men over 65 years old. The jury can be formed only in court of the federal level - the regional, regional or supreme court of the republic.
As a result, until March 15, the Supreme Court, together with the presidential administration, must submit proposals to Vladimir Putin to reform the jury.
