The Federal Court in the New York district Brooklyn refused to oblige Apple to hack the accused’s mobile phone. According to the BBC, the lawsuit was filed in October 2015-a few months before the loud scandal, which was overwhelmed around a similar lawsuit of the FBI with Apple.

In his decision, the judge noted that the current legislation does not oblige Apple to comply with the requirements of the FBI against his will. In this regard, it was decided to reject the lawsuit in full.

The US Department of Justice promised to appeal the decision.

The decision of the New York court cannot formally be considered a precedent when considering Apple's complaint against the decision of the California court. At the same time, the American media believe that the victory in New York still gives the company a certain advantage.

Earlier, the court in California demanded from Apple to provide the FBI employees with access to information stored on the smartphone of the terrorist Said Faruk, who participated in the attack on the Center for Assistance to Disabled in San Bernardino in December 2015. As a result of the attack, 14 people died and 21 were injured.

The company refused to execute a court decision, referring to the first amendment to the US Constitution, which protects freedom of speech.
