
At the first meeting of the repeated process in the case of Primorsky partisans, the lawyers of the defendants noted the unfoundation of the prosecution statements. This was reported in the FB group "Primorsky partisans.info".
At the hearing on March 10, the prosecutor Andrei Cambolin read out the indictment on the case. Among other things, the document stated that the defendant Alexei Nikitin participated in the murder of four alleged drug dealers, committed in the vicinity of the Kirovsky, Kirovsky in September 2009, and was a member of the gang.
This statement immediately caused objections to the defense. Lawyers noted that Cambolin has no right to such statements, since the sentence to Nikitin was completely canceled. Accordingly, the facts of his participation in the gang, as well as involvement in the murder near Kirovsky, have yet to be proved.
Equally unfounded was the approval of the indictment regarding the defendant Vadim Kovtun, whose verdict was also completely canceled. “Kovtun Vadim, fulfilling his role in the attack ...” - read Cambolin. At the same time, the indictment does not contain indications of what role the Kovtun played in the murder.
In the final of his speech, the prosecutor promised the jury to present material evidence, the results of examinations and testimonies of witnesses. Meanwhile, the weapons from which the murder was committed under Kirovsky was never found, and article 222 of the Criminal Code (illegal turnover of weapons) to the partisans during the investigation was incriminated only on the basis of the conclusions of the examination, which announced the gunshot wounds discovered on corpses. Earlier, however, the examination qualified these injuries as knife. In addition, the victims - the relatives of the dead - did not recognize the corpses, and if the bodies in the forest were found, the "extra" leg was discovered.
Cambolin also participated in the first process of partisans along with the main prosecutor - prosecutor Dmitry Obodkov.
On February 18, the judge of the Primorsky Kraisud Marina Karakuyan, with the ninth attempt, formed a jury collegium for consideration of the case. The selection of jury took more than six months.
The hearings were supposed to open on March 2, but they were postponed , since Pavel Zholobov, the appointed lawyer of the defendant Nikitin, fell ill, and during the absence of his absence Nikitin was given another defender, who needed time to get acquainted with the case.
Photo and video shooting was allowed only at the hearing on March 2. The prohibition of the work of photographers and operators petitioned, in particular, partisan Maxim Kirillov. “It will interfere with me to concentrate in the courtroom,” he explained.
On March 10, Nikitin asked about the transfer of a meeting for another three days, explaining that his new defender had not yet fully familiarized with the case. The lawyers of other defendants supported the petition, but Kambolin and representatives of the victims opposed. Karakuyan took their side.
The first process in the case of partisans ended on April 28, 2014 . Judge of the Primorsky Kraisud Dmitry Grishchenko sentenced Alexander Kovtun, Ilyutikov and Nikitin to the life sentences in a special regime colony, Roman Savchenko - to 25 years in strict regime and 2 years of restriction of freedom after leaving the colony, Kirillov - to 22 years of strict regime and 2 years of restriction of freedom, Vadim Kovtun (older brother of Alexander Kovtun) - by 8 years 2 months of strict regime.
In total, there were 23 episodes. One of them was precisely imputed by the five defendants, except for Savchenko, the murder of four alleged drug dealers. The motive for the crime was considered the desire to take possession of a large batch of dried hemp. As stated in the verdict, Alexander Kovtun was the organizer of this crime, Vadim Kovtun - an accomplice, and Ilyutikov, Kirillov and Nikitin - direct performers.
In addition, four partisans - Alexander Kovtun, Ilyutikov, Kirillov and Savchenko - were found guilty of the murders of two policemen. The first of them was committed in February 2010 on Davydov Street in Vladivostok; Lieutenant Grigory Kovalchuk became the victim. According to the accusation, Kovalchuk, along with his partner, Sergeant Nikolai Dubovik, tried to check the documents for the car in which the partisans rode. However, they killed the lieutenant, wounded the sergeant and, taking away a service weapon, cartridges and a walkie -talkie, disappeared. Meanwhile, the testimony of the witnesses of the incident are known, according to which bearded men fired at the police, who looked like visitors from the Caucasus.
The jury also found the partisans guilty of the murder of the police sergeant Alexei Karasius on May 27, 2010 in the village of Rakitnaya, Dalnerechensky district of the Territory. The assessors agreed with the version of the prosecution, according to which the defendants attacked the territorial police station, killed crucian carp and took his weapons.
Along with this, the three partisans - Ilyutikov, Kirillov and Savchenko - found guilty of shelling the traffic police inspectors on May 29, 2010 on the Spassk -Dalniy -Barfolomeevka highway in the Yakovlevsky district. Alexander Kovtun, who was also charged with this episode, was justified.
At the same time, he and Ilyutikov were considered guilty of the wound of two police officers on June 11, 2010, when the security officials captured in Ussuriysk occupied by the partisans.
Five defendants - all except Vadim Kovtun - were also found guilty of a number of robberies, thefts and abductions of people. They were considered members of the gang. According to the assessors, Alexander Kovtun was the organizer of the gang, and Ilyutikov, Kirillov, Nikitin and Savchenko - its participants. With Vadim Kovtun, the charges of banditry were removed for unprovenness.
The jury justified the partisans according to several episodes of theft and robberies. Also, the assessors admitted their guilt in the robbery and arson of the territorial police station at the Bartholomeevka station in the Yakovlevsky district on May 25, 2010.
Alexander Kovtun and Ilyutikov were captured by security forces on June 11, 2010 in Ussuriysk. They, together with two other partisans - Alexander Sweet and Andrei Sukhorada, were blocked in an apartment in a three -story residential building. Sweet and Sukhorada died during the assault; According to the official version, they shot themselves. Kirillov and Savchenko were detained by one by one.
Nikitin and Vadim Kovtun were originally not mentioned among the partisans. They were arrested only a few weeks after the assault in Ussuriysk.
On May 21, 2015, the Supreme Court, having examined the appeal of convicts in the case, canceled the sentences to Nikitin and Vadim Kovtun . It was noted that the verdict of the jury about their guilt in the murder near Kirovsky, "is contradictory and obscure." Three more convicts of the Armed Forces reduced the deadlines, excluding the same episode from the prosecution. The appellate instance appointed 25 years of strict regime, Ilutikov - 24 years, Kirillov - 19 years old. The episode of the murder of alleged drug dealers was aimed at a new consideration.
All five defendants in the sixth year are contained in the Vladivostok pre-trial detention center-1.
Savchenko, who was not charged near Kirovsky, the Armed Forces reduced the term by one year - up to 24 years of strict regime. The verdict to the partisan entered into legal force, and in September 2015 it became known that he was delivered to LIU-1 in Barnaul .
