
The October Court of Belgorod on Thursday, March 24, sentenced to the former doctor of the N2 city hospital Ilya Zelendinov, from whose beatings the patient died in December last year. The surgeon on the death of a local resident Evgeny Vakhtin was found guilty of two articles of the Criminal Code of the Russian Federation - 111 ("Causing grievous bodily harm that entailed by negligence of the death of the victim") and 116 ("Causing beatings from hooligan motives").
As a result, the defendant received nine years and two months in a maximum security colony, TASS reports. He was also forbidden for three years to engage in medical activities. The term is counted from the moment the doctor is detained - January 11, 2016. The accused will be able to appeal the verdict within 10 days in the Belgorod Regional Court.
The judge, voicing the verdict, noted that Zelendinov, "realizing the social danger of his actions and the possibility of causing serious harm, committed two intentional crimes." At the same time, "the court took into account the compensation of the cost of burial as a softening circumstance."
The court will determine the amount of compensation for non -pecuniary damage separately. The victims left the right to demand compensation for damage in a civil order on a separate process. Earlier, a civil lawsuit was filed for the recovery of non -pecuniary damage from Zelendinov in the amount of 3 million rubles in favor of the cohabitant of the deceased Inna Sergeyeva and 55 thousand rubles in favor of a friend of the deceased patient Alexander Avilov.
Also, a petition for non -pecuniary damage from the Belgorod city hospital was given by the daughter of the deceased patient Tatyana Grinev. She asks to recover from the employer of the doctor 3 million rubles in his favor and 1.5 million in favor of her minor daughter. Thus, the total amount of claims for a medical institution is more than 7.5 million rubles.
Protection appeals the verdict
The cohabitant of the deceased after the sentence was announced to Zeendinova that she agreed with the punishment. “Now I believe in justice,” said the woman, whose words are quoted by TASS.
Representatives of the protection of Ilya Zelendinov, on the contrary, consider the sentence too harsh, "unfair and unreasonable," the lawyer of the convicted Julia Logvinova told Interfax . She said that the verdict will be appealed in the upper court. According to her, of course, the doctor is to blame, "but his degree of guilt is greatly exaggerated."
In turn, the plaintiff’s side with the sentence generally agrees. According to Interfax, the representative of the plaintiff Alexander Shpai, "we have not thought about appeal." “In general, the sentence suits us, but we will act in accordance with the wishes of the client,” he said.
The doctor tried to pacify a violent patient
According to the investigation, Ilya Zelendinov during the work shift on the evening of December 29, 2015 went to the reception department of one of the corps of the hospital. The doctor became a witness to the conflict between Vakhtin, who entered the reception department in a state of intoxication, and the nurse Alina Kuchma, who tried to rinse his stomach according to the instructions of the doctor. The patient resisted and in the heat of the struggle hit the nurse with his foot. The woman flew off and hit his head and sick elbow.
Zeendinov also hit Vakhtin in response. After the surgeon hit the patient, having lost consciousness, and died on the spot. According to forensic experts, the cause of death was a blow to the sleepy artery - from it a man began arrhythmia and heart arrest occurred. Having fallen to the floor, he also received a closed traumatic brain injury, as a result of which brain edema developed. Together with Bakhtin, his friend Alexander Avilov, who, as investigators established, also beat Zelendinov.
The 32-year-old medic was immediately dismissed from work, later he was charged with two articles of the Criminal Code of the Russian Federation and arrested. The trial of the doctor began on February 26. The prosecutor's office asked Zeendinov to be sentenced to 10.5 years in a maximum security colony. The prosecution also advocated the deprivation of the surgeon of the right to engage in medical activities for a period of three years. The position of the prosecution at the hearing was supported by the victims, asking the court to impose the most strict punishment.
In turn, the defense asked the court on conditional punishment. Lawyers insisted on retraining the prosecution - on Part 1 of Art. 109 ("Causing death by negligence") and part 1 of Art. 116 of the Criminal Code ("Beatings"). According to the defense, Zelendinov did not have intent, and all the actions of the physician fit into the framework of the necessary self -defense. Lawyers emphasized that the employees of the city hospital, where a fight occurred, repeatedly suffered from patients. Zeendinov himself pleaded guilty, emphasizing that he had no intent to beat and even more so to kill the patient.
