The State Duma Committee on Constitutional Legislation and State Construction, during a meeting on April 11, recommended to its colleagues to adopt in the second reading a bill that would double the maximum number of possible hours of compulsory work.
The bill was introduced by the government in December 2015. Relevant amendments are proposed to be added to some articles of the current Code of Administrative Offenses, as well as to Art. 33 and 109-2 of the Federal Law No. 229 "On Enforcement Proceedings".
Today, according to part 2 of p. 3.13 and part 10 of Art. 32.13 of the Code of Administrative Offenses, the offender can devote no more than four hours to compulsory work on his free day, and only 2 hours on a working day, which, according to the authors of the bill, significantly delays the execution of an administrative penalty. According to them, often persons who have been sentenced to administrative punishment in the form of compulsory work apply with a request to serve their sentence for a full eight-hour working day.
In this regard, the government proposes to increase the maximum possible time of compulsory work to eight hours on weekends. The profile committee recommended to colleagues to adopt the draft law in the second reading, specifying some details in it. Thus, an increase in the time of compulsory work will become possible only on the basis of a written application of a person who has been sentenced to an administrative penalty, and a bailiff will have the right to decide on the satisfaction of the application.
