At the hearing in the UNA -UNSO case, continuing in the Supreme Court of Chechnya, testimonies were announced, which questioned the participation of a citizen of Ukraine Alexander Malofeev - a key witness of the prosecution - in the first and second Chechen wars. This was reported by the "Caucasian Knot" with reference to Marina Dubrovina, who protects the accused Stanislav Klykh.
We are talking about the testimony of the ex -wife of Malofeev and his stepfather, the lawyer explained. The ex-wife said that she had never heard that Malofeev fought somewhere and receive firearms. The stepfather of the key witness, in turn, stated that the wound, about which Malofeev himself, in the investigation and court, spoke of as received in the war, was actually received by theft of metal.
In addition, at the request of Dokka Itslaev, the lawyer of the accused Nikolai Karpyuk, two more witnesses were questioned in the video. The first was the district police officer from the annexed Crimea, who dealt with Malofeev when he lived on the peninsula that was long before the capture of Crimea. According to Dubrovina, the security officer gave the key witness the accusations “fairly sharp characteristics”, and also noted that in Ukraine Malofeev was twice convicted.
The second interrogated was a resident of the Novosibirsk region, who said that about two years after the second arrival of Russia, Malofeev was convicted of double murder.
The hearing in the case will continue on Thursday.
The accusation of Karpyuk and Klykh is essentially built exclusively on the testimony of Malofeev. At the same time, Open Russia previously reported, not indicating its sources that this witness, before dealing with robberies, really fought in Chechnya. However, the testimonies announced on Wednesday make you take the information of the publication critically.
After leaving Ukraine after serving the deadlines, Malofeev in the Novosibirsk Region took part in a robbery, during which two women were killed. In 2009, he was convicted of this to 23 years of strict regime.
According to some reports, the convicted person was serving his term in the Sverdlovsk region. Since the end of 2013, operatives began to visit Malofeev, and since March 2014, his testimony on Ukrainian politicians and activists began to appear in the case. It was noted that if the testimony of Ukrainian politicians Arseniy Yatsenyuk and Dmitry Yarosh was present in the case from the very beginning, then the first testimonies against Karpyuk Malofeev gave only the day after the carpyuk was detained . The testimony against Klych in the case also appeared only after the detention of the defendant.
The case against the Malofeev himself was allocated in a separate production. He made a deal with the prosecutor’s office, and his case was considered in a special order. On September 29, 2015, the Shatamosky district court of Chechnya sentenced the accused to 14 years in a maximum regime, and taking into account partial addition to the previous sentence - to 24 and a half years . He fully recognized the Fabula of the prosecution, saying that he participated in both Chechen wars.
Malofeev is a heroin addict. He also suffers from HIV infection, tuberculosis and two types of hepatitis.
On November 17, 2015, Malofeev testified in the process of Karpyuk - Klykh . In particular, he described UNA-UNSO as "the organization of a nationalist sense aimed at destroying Russian nationality."
On December 31, 1994, Malofeev continued, he was with a sniper rifle in the house of Grozny Square a minute. The Ukrainian unit participating in the battle on this square commanded, according to him, Karpyuk. In the evening of the same day, the witness told, the activist UNA-UNSO Alexander Mulychko (Sashko Bily) called him and said that the federals were surrounded by the Presidential Palace and the help of Ukrainians was required. On the same night, according to Malofeev, he met at the railway station with Karpyuk, Muschko, Yarosh and Yatsenyuk.
Among other things, Malofeev also stated that since then he "has remained the same ideology, it is in the blood."
Meanwhile, when the lawyer Itslaev asked why the witness decided to testify only 20 years after the events described by him, he replied that he was a religious person and, when "he began to read, he realized that he had to tell about it."
Dubrovin’s lawyer, in turn, asked why Malofeev did not immediately began to mention her client in his testimony. “These events were 20 years ago,” the witness answered. “Therefore, whose surnames I remember, they call them.”
At the same time, as follows from the later -prepared certificate of the Memorial human rights center , the testimony of Malofeev are falsified. In particular, the area of the minute in the last days of 1994 and the first 1995 was in the deep rear of the Chechen troops and battles was not conducted there. On the other hand, Ukrainian volunteers could not, contrary to the statement of Malofeev, in February 1995 to torture prisoners of federals on Pervomaiskaya Street, because at that time this part of the city, on the contrary, was in the deep rear of the Russians.
The trial on the merits of the UNA-UNSO case began on October 26, 2015. The process is conducted by Judge Wahit Ismailov; The case is obeyed with the participation of jury. At the same time, the defendants themselves do not participate in the meetings: at different times, Ismailov removed them from the hall for the entire period of the judicial investigation, before the beginning of the debate of the parties.
A member of the leadership of UNA -UNSO Karpyuk is charged with part 1 of Article 209 of the Criminal Code of the Russian Federation (organization of a gang), and part 2 of the same article (participation in the gang) to the Kyiv teacher and journalist Klykh. In addition, both paragraphs of "B", "Z", "H", "H" of Article 102 of the Criminal Code of the RSFSR (intentional killing of two or more persons in connection with the fulfillment of official debt committed by preliminary conspiracy by a group of persons) and part 2 of article 15 are the points, "B" 102 of the Criminal Code of the RSFSR (attempted assassination for the same crime).
According to the prosecution, in December 1994 - January 1995, Karpyuk, Klykh and other Gang participants fought with the Russian military in Grozny in the territory of the Presidential Palace, as well as a minute and railway station on the square. Karpyuk, as stated, headed the "gang" called "Viking", and Klykh was its member. During these battles, according to the prosecutor's office, they "deprived their lives of at least 30 military personnel and at least 13 military personnel were injured in varying severity." Both of the defendant is charged with participation in the Second Chechen War.
In Klych, in conclusion, as a result of torture and bullying, breakdowns began. During the meetings, he repeatedly discovered signs of a mental disorder. Dubrovina has achieved the sending of her principal to psychoexpertise, but the examination recognized him as healthy. At the same time, from mid -February, Klyu in the Grozny pre -trial detention center began to be forced to take some unknown drugs and injections.
Last week, it became known that the case of the insult of the prosecutor S. Yunusov was opened against Klykh . When Yunusov began to prove the need to further maintain the defendants in the pre -trial detention center, he did not let him speak, interrupting the prosecutor with insults to him. "
