A resident of Chuvashia Dmitry Semenov from Chuvashia, sentenced to a fine for the repost of the VKontakte demotivator, filed a complaint with the European Court of Human Rights. This was reported to the "Franes" by lawyer Damir Gainutdinov, representing the interests of Semenov in Strasbourg.
The plaintiff believes that in Russia his rights to a fair trial and freedom of expression of opinions are violated (Articles 6 and 10 of the European Convention on the Protection of Human Rights and Fundamental Freedoms). As in Russian courts, Semenov once again emphasized in a complaint in the ECHR that he like the text of the interview, and the caricature on the prime minister was attached automatically, as is usually the case on social networks.
“In May 2014, Semenova was already brought to administrative responsibility for this repost, that is, he was actually condemned twice in the same offense,” said Damir Gainutdinov. “At the same time, the court used the court to justify the conviction. This violates Article 4 of Protocol No. 7 to the European Convention, which guarantees the right not to be judged or sent twice.”
Semenov’s verdict on September 17, 2015 was issued by the judge of the Leninsky District Court Cheboksar Evgeny Egorov. He fined the opposition for 150 thousand rubles , but freed him from paying the penalty, applying an amnesty to the 70th anniversary of the victory over Germany, and removed the criminal record from the activist. Semenov was found guilty under Part 1 of Article 280 of the Criminal Code (public calls for extremism), which provides for the four years of the colony. The activist and his lawyer Yevgeny Gubin himself insisted on an acquittal.
Hearing on the merits of the case, which began on July 27, took place closed. Judge Egorov made such a decision at the request of some "witnesses from the FSB." The only announcement of the sentence was open.
The reason for the initiation of the case against the activist was the publication on his personal page on VKontakte images of Prime Minister Dmitry Medvedev in the Caucasian papa with the signature of the Death of the Russian Gadin. The caricature was placed in March 2014, in the context of the annexation of Crimea.
“When all the events in Ukraine began, our media loved to say that we are protecting the Russian -speaking population,”Semenov commented on this post “faces.” “But we forget about the Russians in Turkmenistan and the North Caucasus republics. Our Russian authorities are dusty in the eyes.”
Meanwhile, the FSB saw in the publication of Semenov a call to kill Russians.
On January 29, the special service conducted searches of the house at Semenov in Cheboksary and his parents in the nearby district center of Tsivilsk. The security forces seized the iPad and the activist laptop. On February 2, the blogger was charged . A number of examinations were held in the case. All the time before the end of the process, the activist remained under the subscription about the lower room.
In mid -May, it became known that Rosfinmonitoring included Semenov in the list of terrorists and extremists , thereby blocking all his bank accounts.
