“The Moscow City Court overturned the decision of the Solntsevsky Court and returned the case to the prosecutor’s office due to procedural violations,” the court’s press service reported.
In early March, the Solntsevsky District Court of Moscow granted the defense’s request and sent Gadzhieva’s case to the Moscow District Military Court, which has jurisdiction over cases under articles on terrorism in accordance with changes to the Code of Criminal Procedure, which came into force on January 1, 2015. The prosecutor's office appealed the district court's decision.
According to the investigation, in October 2015, student Gadzhieva published a post on her VKontakte page that contained calls for terrorism and incited interreligious hatred. The post has now been removed from her page.
The student's defense claims that she had no intent to commit a crime. If Gadzhieva’s guilt is proven, she faces up to five years in prison.
