
The Gaaga District Court canceled the arbitration decision on the payment of $ 50 billion to former shareholders, since Russia did not ratify the agreement to the European Energy Charter. This is stated in the published court decision .
“The court concluded that in order to attract the Russian Federation to the proceedings on such disputes, the presence of a corresponding legal norm, which would be ratified by the Russian parliament,” the document says.
The decision also specifies that the court in this way did not have jurisdiction in relation to the specified process.
The district court abolished the decision of the Hague Arbitration Court to recover $ 50 billion with the Russian Federation in favor of former shareholders of the oil company on April 20. The court also decided to pay for the costs of € 16801 incurred by Russia during the proceedings.
The decision on the claim against Russia was issued in January 2014. The court admitted that the former shareholders of the Yukos were illegally deprived of assets. Since the beginning of 2015, a penalty of 1.9% per annum daily, that is, $ 2.6 million per day, has been charged to $ 50 billion. In addition, from last year in several European countries, the arrests of Russian property began as a security measure in a lawsuit.
