
The Embassy of Ukraine in Moscow sent a note to the Russian Foreign Ministry with a request to “assist in a careful consideration in the Kirov Regional Court” of the appeal about refusal to Udo Euromaidan Alexander Kostenko, who was serving a term of three and a half years in IK-5 of the general regime in Kirovo-Chepetsk. Facsimile of the document dated April 19, on Thursday, was published on his FB page by the lawyer of the politicalese Dmitry Sotnikov.
In its note, the embassy recalls that according to the decision of the Plenum of the Supreme Court, the existence of a penalty, to which on April 13 he referred to his refusal decision, Kirovo-Chepetsk District Court cannot serve as an obstacle to UDO. “At the same time (Kirovo -Chepetsky. - Ed.), The court did not reflect in the decision the nature of the violation committed by the convict, by virtue of which he received the penalty, and did not give him proper legal assessment, limiting him only to the declaration of the fact of the recovery itself,” the diplomats emphasize.
Kirovo-Chepetsk district court, said in a note, also referred to the fact that Kostenko consists in preventive accounting as a person, "studying, propagandizing, professing or spreading extremist ideology." Nevertheless, the court did not find out what the registration was related to, the authors of the appeal indicate.
In addition, diplomats report the presence of serious health problems, in particular the non -healing hand fracture. "The father also disappeared by A.F. Kostenko, his mother suffered two strokes, a young child is located on dependent," the document says.
On April 12, the day before consideration by Kostenko’s petition for Udo, the Politzeck was sent to the schizo - allegedly for the fact that he was not repeatedly greeted by an employee of the colony. The lawyer Sotnikov then regarded the actions of the FSINITS as a provocation in order to achieve a refusal resolution at the request of the Maidanist.
At the trial of April 13, the representative of IK-5 failed to explain the reasons for the staging of Kostenko on the professional science. In addition, he admitted that the political zyt is not employed only because there are no empty seats in the colony. Also, the FSINovets could neither confirm nor refute the Maidanist’s statement that he was mastering a working profession in the colony.
The court was attended by the General Consul of Ukraine in Moscow Gennady Breskalenko. As noted, he also intended to visit the colony and meet with Politzek.
On May 15, 2015, the judge of the Russian Kiev District Court of Simferopol Viktor Mozheleansky sentenced Kostenko to 4 years 2 months of a general regime under paragraph “b” of part 2 of article 115 (intentional infliction of mild to health or enmity against any social group) and part 1 of Article 222 of the Russian Criminal Code (illegal storage of weapons). On August 26, the College of the Russian Supreme Court of Crimea (Judge -Rosaiser - Sergey Togrebnyak) reduced the Maidanovsets up to 3 years 11 months . On February 24, 2016, the Presidium of the same court (Judge-Rosaiser-Viktor Vasiliev), excluding from the prosecution to the political prisoner under the 222th article qualifying signs of wearing and acquiring the main parts of weapons, reduced his term for another five months.
The courts of all instances considered proven that in February 2014, on Grushevsky Street in Kyiv, the activist threw a stone at the Crimean Berkutovsets Vitaly Polienko, from which a bruise was formed on his hand, and that Kostenko kept a homemade rifled trunk of Makarov’s pistol at home. Politzek himself refused to admit the guilt.
Kostenko received a fracture of his hand on February 5-6, 2015, immediately after the detention of the FSB in Simferopol, as a result of torture. In torture, operatives Major Andrei Tishenin and Captain Arthur Shambazov participated in torture. The belated operation, carried out after the sentence, did not help after the fracture three months after the fracture, however, until sending in the autumn to IK-5 in further medical care, the politicalese was refused.
On March 21, Sotnikov said that the FSINS doctors are imposing a new operation on his hand , but the political prisoner himself fears medical procedures in the colony and insists on hospitalization in a civilian hospital.
The father of the Maidan, Fedor Kostenko, went missing more than a year ago. He disappeared on March 3, 2015, after he entered Crimea from continental Ukraine. Sotnikov did not exclude that Kostenko Sr. could be accidentally killed during the detention of Russian security forces.
