The performance of Shutdinov came down to the fact that there was no evidence of his guilt in the case file, namely confirmation that the agreement on the implementation of gas distribution networks between Dagestangagongaz and Daggaz, he signed not in 2002, but in 2008, as the state prosecution claims.

- As evidence, the prosecution tried to use the expert Adzhiev , from which it follows that all the gas pipelines available on the balance of Dagestangazer in April 2002 were implemented by the administrations of the districts. However, you remember how the expert invited for interrogation explained that his conclusions regarding the disposal of gas networks to the municipalities are incorrect, ”Naskydinov reminded the court.

In his speeches, the prosecutor and the representative of the victim, lawyer Vladimir Komarov , indicated that there was not a single mention of the contract of sale in any documents of 2002. Shootdinov referred to the testimony of the chief accountant of Dagestangiongaz, which in court explained that Daggaz delayed the procedure for signing a contract of sale, trying to coordinate the procedure for payment and clarify the length of gas networks in the contract. In addition, the court establishes the fact that in April 2002, employees of Dagestangiongaz massively moved to Daggaz. This is more than a thousand people. This fact does not question the prosecution, but regards it as not related to this case. That is, that this fact is not a confirmation of the implementation of gas networks in Daggaz.

-It is convinced that, not having the opportunity to object to anything on this matter and in order to at least somehow justify the transition of employees, the prosecution takes the simplest position. The position of denial. However, it is worth considering why Daggaz needs extra workers who need to pay a salary, despite the fact that there were many of their employees. I argue that this was due to the purchase of gas networks from Dagestangagongaz. “Interregiongaz” could not know about this, since there was a significant reduction in expenses. By the logic of the prosecution, I wanted to get these networks for myself. Ask the question: why didn’t I bring them to some private enterprise or where I can dispose of them alone? - turned Shuvdinov to the judge.

The conclusion that the contract of sale was concluded in 2002 is confirmed by the report of the FSB operative, after which the previous criminal case (already closed) was previously opened on it. According to the report, in 2002, Nasvddinov signed this agreement without the knowledge of the board of directors and founders. That is, then it was not questioned that the contract was concluded in 2002. However, when the current criminal case was opened on Shutdinov, it turned out that the contract allegedly signed in 2008 retroactively.

The state prosecutor, according to Shoesdinov, pulls out of the materials of the case those circumstances that are beneficial to him, “adjusting” the examination data in the right direction. As an example, the results of the examination carried out by the employees of the FSB forensic Institute of Forensics were given. The study of the protocol of the extraordinary general meeting of the participants of Dagestangiongaz (from 2001) set, in his opinion, before the investigation the “complex task”.

- What to do when the protocol was signed by Nikishin , but he died in 2005? The results of the examination indicate that the paper was made no earlier than 2006. Common sense tells us that Nikishin could not put his signature on paper, which was made a year after his death. The prosecution did not succeed in resurrecting Nikishin or change the date of his death, but the expert managed to change the date of manufacture of paper for 2005. I am sure that all those present in the hall for the year that was spent on consideration of this case were clearly convinced of the far -fetched accusations and weakness of the resources of the prosecution. The interest of the victim in my isolation, efforts on my discrimination, the only, unfortunately, their opponent, is no secret to anyone. By translating an ordinary dispute between enterprises into criminal law, customers managed to maintain the existing abnormal state of affairs in the gas industry of the republic for some time. But they could not break me or force me to shut up, regardless of the decision that the court will make. I assure all loved ones, friends, colleagues, that no matter how much I needed time and effort, I will prove my innocence, I will achieve the restoration of an honest name, which I am proud to wear ... I want it to be clear why I suddenly become bad. First: never in Dagestan the concepts of “dumping gas” existed. In Dagestan, gas losses according to the norm were 3%. In the worst years, in the 99th year, we fit into these normative losses. In Dagestan introduced gas losses from 40 to 42%! Imagine gas enters Makhachkala, and 40% goes into the air?! The whole city would burn, and there would be endless explosions. This gas is plundered! Second: I raised the question that the price of gas is artificially overstated ...

“We are not discussing the formation of prices and production issues here,” the judge interrupted Nasrutdinov. But he was determined:

- I'm not about the formation of prices. I want to say why they are pursuing me. It matters! I will continue ... On the well, gas is worth a penny. The entire price is formed due to its transportation. I constantly posed this question. The last time-at a meeting with Khloponin (Alexander Khloponin, Deputy Prime Minister of the Government of the Russian Federation, the former presidential envoy to the North Caucasus Federal District- “Cheka” ). I want to say that if there is an indictment, I will put all my energy, all my knowledge, time and all resources to prove that it is unfair. Not because I myself need it myself. I need the good name of my family, my father, who from scratch begins the gasification of the republic ... so that this decision does not overshadow the future to either my children or my nephews, so that they proudly wear the surname of the Nessutdinov. I have everything, ”he completed the performance, causing prolonged applause of the hall.

Golden gas pipelines

Now everything seems to be. Kurban Zulfigarov, as befits a representative of the most independent structure in the country, must simply be obliged to make an impartial decision. However, the judge turned out to be clamped by stiff circumstances, because of which he followed the result of the investigation, the prosecutor's office and other invisible influential offices of federal subordination. And, despite the fact that the President of Russia Vladimir Putin also speaks of the extremely honest approach of judges when issuing verdicts, most likely a decision that is pleasing to the prosecution. And, unfortunately, he will no longer pay attention to the fact that there is not a single centimeter of gas networks, around which the investigation , in reality, did not get anywhere in the causing of which was accused of Shutdinov. The judge will no longer figure out who drove the employees of the Republican Center for Forensic Examination, demanding to accept and recognize the results pleasing to the charge, will not delve into the fact that, at one time by ordering the municipal networks, Naskydinov actually gave the meaning of this, roughly speaking, the ownerless snot of the foggy. Magomedgusen Shoisutdinov, in principle, could be free today if he had been dealing with numerous walkers that “faded” the brains and offered “help” in exchange for high -blooded papers. However, he did not go to it, preferred to “fight” to the last, although he understood that this was fraught with a real term with seriously undermined health.

The situation in the gas sector of Dagestan today is such that even for the period while Nasitdinov is sitting behind bars, debts for the consumed fuel increased by several billion rubles. This is despite the fact that the defendant was both in power and being behind bars, he repeatedly repeated that there is no concept of “lost gas”, but there is only a stolen one. The entire shore of the Caspian Sea in the Dagestan section is built up with expensive, but illegal objects (houses, restaurants, banquet halls), which, not existing on paper, nevertheless use natural gas and do not pay for it. Add here numerous brick factories burning tens of thousands of gas cubes, but preferring to solve the issue in private with controllers. As a result, the entire stolen gas lies on the shoulders of the population. Therefore, thousands of Dagestanis, having in their hands, receipts for payment for fuel, receive notifications of thousands of debts. In addition, in Dagestan there are “golden gas pipelines”.
