The problem with the borders of the municipalities of the republic was to be resolved with the adoption of the relevant law in 2012. However, it turned out that he further aggravated the situation. The territory, which will be discussed in the first part of the material - the coastal strip of the Caspian Sea, is located near the city of Izberbash and is the land of the state government of the Kayakent district, that is, federal property and is reserved for resorts of republican significance.

The Law of the Republic of Dagestan No. 13 of March 12, 2012 “On approval of the boundaries of municipalities of the Republic of Dagestan and on amendments to the Law of the Republic of Dagestan“ On the status and boundaries of municipalities of the Republic of Dagestan ”” approved the boundaries in accordance with the requirements of urban and land legislation. They tried to recognize this law invalid through the Kayakent district and the children's health camp "Rusalka". The fact is that after the establishment of new borders, the plots that had previously belonged to the Kayakent district passed to the Izberbash. In addition to the territory under the camp, about 300 plots got into such a situation. And if, by force, the decision of the Supreme Court of the Republic of Dagestan dated September 3, 2015, to which the above law was not invalidated, then all these lease agreements must be canceled.

In the determination of the Supreme Court of the Russian Federation of November 25, 2015, one of the arguments is indicated that the border of Izberbash was established taking into account the historically established territory of nature management of the inhabitants of the coastal zone of the Caspian Sea for the organization of rest. In addition, this territory directly adjoins the urban district and is partially located between the Dagzeto plant and the sea. For a long time was in the use of the plant, which belongs to the enterprises of Izberbash.

The fact that it is impossible to establish the boundaries of the Kayakent district, since this requires the coordinates of repeated points of the borders indicated in the local coordinate system MSK-05, the RD prosecutor's office says.

Meanwhile, the Office of Rosreestr for the Republic of Dagestan reports that the changes in the area of the Kai-Kentsky district and Izberbash from 2003 to 2014 did not occur.

However, the area of Izberbash increased from 2255 to 2551.29 hectares, and the area of the Kayakent district decreased from 69 108 to 68762.53 hectares. As a result, the district lost land located on the coast of the Caspian Sea and in the northern part of the M-29 federal side, south of the Kolichi River.

In 2015, in court in the case in respect of the former head of the administration of Izberbash Zubair Mustafaev , it was established that the coastal strip of the Caspian Sea dates back to the territory of the Kayakent district and is federal property. Recall that Mustafaev was accused of providing sections of the coastal zone into property. The defendant assured that the data of the land belonged to the Izberbash.

Another criminal case under the article “Office forgery” is associated with these lands. The Office of the Federal Antimonopoly Service in the Republic of Dagestan in the Ministry of Justice of the Republic of Dagestan was presented with knowingly false materials with the coordinates of the water strip on the coast of the Caspian Sea, indicating the imaginary attack of the sea on the coastal strip of Izberbash. The investigation established that the Geokom LLC did not carry out the work of water and such orders and such orders were not given. However, the preliminary investigation in this criminal case is suspended. They cannot find a guilty face.

As a farmer, a farmer from Steelsky Malamagomedov from 04.04.2014 leased a land plot of 24 hectares for the cultivation of wheat. They concluded an agreement with him for 11 months, although they should have been for 49 years. The rent was set at 7,200 rubles.

According to Malamagomedov, the terms of the contract were fulfilled in full and in a timely manner. Until the expiration of the period on November 30, 2015, he repeatedly applied to the administration of the village of Steelsky with a statement on the extension of the contract. However, his statements were not accepted and were not registered by the head of the administration of the village council Omarov. After some time, it turns out that this section is transferred to another tenant. Before the lease expiration, the administration issues an order to put up land for auction. Protocols on the results of trading were not exhibited to the public procurement website.

“According to the law, I had a preemptive right to conclude a lease agreement for a new term. At the moment, there are seedlings of wheat sprouts on this land plot. In addition, the registry indicates incorrectly cadastral number 165 instead of 165/5 and the amount of rental payment - 624 rubles instead of 7,200 rubles, ” the farmer explained.

Malamagomedov filed a lawsuit against the administration to recognize the auction and the transfer of its site illegal.
