The upcoming alleged exchange of the Ukrainian military personnel of Nadezhda Savchenko , convicted in the Russian Federation for the murder of VGTRK journalists in the Donbass, in the Russians Evgeny Erofeev and Alexander Alexandrov , found guilty of the aggressive war and terrorism in Ukraine, may not take place. This "Radio Freedom" was stated by Erofeeva Lawyer Oksana Sokolovskaya.
"As far as I understand, we all understand - this is a bilateral agreement. Both Russia and Ukraine took a pause in this matter. There were certain agreements that have not yet been implemented. It is possible that the parties are waiting for the sentence to Erofeev and Aleksandrov. But now I come to the conclusion that the exchange may not take place. And in the event of an appeal, our clienteles will be deprived of the right to further appeal, including in The European Court of Human Rights, in our opinion, is an illegal sentence, ”she said.
According to her, agreements were previously reached, in particular, suggesting the exchange of convicts through the procedure for pardon by the presidents of Russia and Ukraine. At the same time, there were no such steps in Kyiv or in Moscow, she added. Sokolovskaya at the same time noted that if Savchenko does not have the issue of appealing the verdict, then he is still relevant for Erofeev and Alexandrov.
"Now we doubt that agreements can be fulfilled to transfer convicts to their homeland, because it is necessary for Ukraine to recognize Savchenko’s verdict, and Russia is the verdict of Erofeev and Aleksandrov. However, it is obvious that neither one nor the other side will do this. Thus, Ephev and Aleksandrov will be deprived of any right to appeal, and they will be forced to leave the sentence in Ukraine, if, of course, they will not be, of course, if, of course, they will not be. I had the previous agreements that the exchange was planned before the May holidays.
Lawyer Savchenko Mark Feigin, in turn, said that he did not have information about the termination of exchange negotiations, Ukrinform reports. "I do not have such information. I want to emphasize that in this situation I am generally afraid to comment on the political component. At the highest level, the decision is made fundamentally. The question is still how to translate it into a strict legal plane," he explained.
Feigin also emphasized that he was not considering the case of Erofeev-Aleksandrov. In his opinion, in the current situation, negotiations are underway and should not be conducted at the level of lawyers, but at the level of political leaders and their plenipotentiary representatives.
The authorities of Ukraine repeatedly demanded the liberation of Savchenko and its issuance to Kyiv. At the same time, on April 18, two Russians Evgeny Erofeev and Alexander Alexandrov were convicted in Ukraine. They were found guilty of the conduct of aggressive war and terrorism and sentenced to 14 years in prison with property confiscation. It is assumed that after the sentence to the Russians will enter into force, they will be exchanged for Savchenko.
Nadezhda Savchenko was convicted in Russia to 22 years in a colony in the case of the murder of VGTRK journalists in the Donbass. The court found that she conducted hidden observation and adjustment of artillery fire during shelling, during which Russian correspondents Igor Kornelyuk and Anton Voloshin died. Savchenko herself rejects all the accusations.
