Four years later, the court ordered the Federal Penitentiary Service to remove a nail from the chest of a Chita convict

The Ingodinsky District Court of Chita ordered prison doctors from hospital No. 1 of medical unit No. 75 of the Federal Penitentiary Service of Russia in the Trans-Baikal Territory to remove a fragment of a nail from the body of convict Mikhail Derbin, with whom he has been living for almost 4 years, the human rights organization “Zone of Law” reports.

Almost 4 years ago, prisoner IK-2 Derbin, suffering from hepatitis and re-arthritis of the joints of his toes and hands, drove a nail into his chest in protest against inadequate medical care. He complained that he was not receiving proper treatment, and the necessary medicines that his mother gave him to the colony were destroyed by the colony staff. After the protest, Derbin began to complain of severe pain in his lung and asked to remove the foreign body.

The FSIN doctors examined the prisoner and refused to operate on him, citing the fact that “the foreign body was encapsulated, the prisoner’s health condition remains satisfactory and there is no need for urgent surgical intervention, since there is no bleeding or suppuration in the chest.” According to the colony staff, “it also deserves attention that Mikhail Derbin intentionally injured himself, violating the duty to take care of maintaining his health as provided for by law.”

When making its decision, the court took into account the opinion of Derbin’s representative that Roszdravnadzor for the Trans-Baikal Territory back in 2012 pointed out significant violations of the rights of the convict, who “was not hospitalized in a surgical medical institution on an urgent basis.” Based on the results of inspections, representatives of the supervisory agency annually recognized the right of the convicted person to have a planned operation, but it was still not carried out.

The court decided to organize an operation to remove the nail from the body of the convicted person within six months from the date the court decision entered into legal force.
