
The Leninsky district court of Makhachkala during the re -trial in the case of the murder of the responsible secretary of the avaricious newspaper Xӏkiikat ("Truth") and the editor -in -chief of the newspaper "Sogratl" Malik Akhmedilov gave the accused the same terms as during the first consideration of the case. As in the first process, Murad Shuaybov received 10 and a half years of strict regime under Part 1 of Article 105 (murder) and part 1 of Article 222 of the Criminal Code (illegal arms trafficking), Isa Abdurahmanov - 8 years of strict mode under part 5 of Article 33 - Part 1 of Article 105 (aiding in the murder). The mitigating circumstance the court found the presence of a young son in Shuibov. It is also noted that Abdurakhmanov is a disabled person of group II.
The prosecutor requested for the defendants 13 and 10 years, respectively. Shuaybov and Abdurakhmanov themselves did not plead guilty.
The verdict following the results of the first consideration of the case was issued on March 30, 2015 . However, on July 15, the Supreme Court of Dagestan, having examined the appeal of the defense, canceled the decision and sent the case for a new consideration.
As noted, Akhmedilov’s colleagues also stated that the investigation was conducted with violations, and law enforcement officers did not try to establish all the circumstances of the incident. At the same time, the chairman of the Union of Journalists of Dagestan Ali Kamalov, at the end of the first trial, claimed that the guilt of Shuibov and Abdurahmanov was fully proven in court, and only complained of the excessive, from his point of view, the softness of the sentence. At the same time, after the current sentence, Kamalov said that only the performers of the crime were convicted, while no one was engaged in the search for customers.
Akhmedilov was killed on August 11, 2009 in the country village of Palmyra in Makhachkala with a shot in the stomach. The case materials stated that Shuaybov arrived in the village at Lada Priora Abdurakhmanov and, waiting for the journalist to drive past his “Lada”, fired twice from a crossbow of a hunting rifle. Akhmedilov died on the spot.
The accused were looking for three and a half years. Shuaybov was detained on January 29, 2013, Abdurakhmanov - April 4. Both gave confession. As the TFR stated, Shuaybov explained that he killed Akhmedilov, for the fact that he disseminated information that did not correspond to reality about his commitment to Wahhabism.
During the first process, which was held closed, Shuibov’s defense stated that the accused's confessions were received under torture. Abdurakhmanov in the last word called evidence of the accusation by falsified. Lawyers during the first proceedings insisted on retraining of Shuaybov’s actions from Article 105 to Part 1 of Article 109 of the Criminal Code (murder by negligence). They demanded that Abdurakhmanov justify as not involved in the crime.
Repeated hearings in the case began on September 2, 2015. At the new trial, lawyers demanded to re-qualify the charge from the 105th to the 109th article to both defendants in the case.
