
The first complaint about criminal prosecution under Article 212.1 of the Criminal Code (repeated violation of rallies) was filed in the European Court of Human Rights, Kommersant reports . The applicant was activist Vladimir Ionov, who left for Ukraine a few days before the announcement of his sentence.
The persecution of Ionov violates the right to freedom of expression, since his protest was peaceful, the complaint filed in the ECHR said. The document notes that Article 212.1 contradicts the European Convention on the Protection of Human Rights and Fundamental Freedoms. The lawyer Irina Khrunova, representing the interests of Ionov, reports that the article twice punishes the same act twice: the citizen first receives administrative penalties, and then becomes a defendant in the criminal case.

Formally, Ionov did not exhaust the funds in defense in Russia, since the verdict was never passed to him, Khrunov admits. “But the applicant is sure that only a conviction and punishment in the form of a prison would definitely be against him. That is why the applicant disappeared from the court,” the complaint said.
Ionov became the first activist pursued under Article 212.1 of the Criminal Code (repeated violation of rallies). The case against him was opened on January 16, 2015 . After the initiation of the case, the activist was under the subscription about the lower room. The trial has been on it since September.
On November 25, in the debate of the parties in the case of Ionov, the prosecutor requested for the defendant three years on a conditionally with a three -year trial period, as well as a ban on departure from Moscow and visiting mass events. Ionov then told the "faces" that this restriction would not be observed ( 
The verdict to the activist was supposed to be announced on December 10, but three days earlier, after the sentence, Ildar Dadin , who received three years of real term on the same charges, Ionov began his heart problems. He was in intensive care with a diagnosis of unstable angina pectoris. Ionov’s performance with the last word and the announcement of the sentence were postponed to December 23.
On December 21, Ionov said that he fled to Ukraine . An activist who does not have a foreign passport, illegally crossed the Russian-Ukrainian border. Then he submitted documents for political asylum.
On January 25, the ECHR registered the complaint "ions and others against Russia." The applicants were civil activists of ions, Irina Kalmykova, Elena Koroleva, Masha Ryabikova and Anastasia Sheveleva. The complaint was filed in connection with the beatings inflicted by Ionov in the Preobrazhensky police department, in connection with the ineffective investigation of beatings, due to the inappropriate conditions for the maintenance of all applicants, due to violation of applicants' right to freedom and personal inviolability, due to violation of the right of the applicants to freedom of peaceful meetings and due to the absence of effective funds from the applicants of effective means legal protection.
