I inform you that in Moscow the mass judicial bacchanalia for expulsion beyond the borders of the Russian Federation of respectable foreign citizens who did not commit any violations, which, on far -fetched grounds, are held accountable for police officers.
So, by the decision of the Chertanovsky court of Moscow dated March 9, 2016, Matysaev Nurali, born in 1989, a citizen of the Republic of Kyrgyzstan, was found guilty of an offense under Part 3 of Art. 1.8 Administrative Code of the Russian Federation and sentenced to a fine of 7000 rubles. With expulsion outside the Russian Federation.
On March 9, Matysaev was detained by a police officer, who, in violation of the requirements of Part 2 of Art. 13 3-ФЗ “On the Police” without any reason demanded that Matysaev present documents to him. Having studied the passport, migration card and registration of Matysaev, the police officer said that he had no patent. To Matysaev’s explanations that he, as a citizen of the country included in the Customs Union, is not obliged to formalize the patent, the policeman began to threaten Matysaev with a deportation, delivered him to the FMS, where he said that Matysaev had only a passport with him, and allegedly forgot the migration map and registration at home.
In court, admitting official forgery, police officers also said that Matysaev supposedly did not have a migration card and registration with him.
There are numerous violations in the case.
So, 115-ФЗ “On the legal status of foreign citizens in the Russian Federation” (as amended on December 30, 2015) does not require foreign citizens to carry these documents with you. At the same time, from the report of the duty officer on the analysis of the 8th department on the metro Egorov S.O. It is noted that the relatives of Matysaev, whose surname was not indicated, were delivered documents.
Police officers allowed a repeated official forgery:
- hiding from the employees of the FMS and the court there were documents that had been in Matysaev;
- hiding from the court the availability of Egorov’s report that Matysaev’s documents were allegedly delivered by relatives, and Matysaev allegedly lost the documents;
- Putting on behalf of the “witnesses” of police officers Ukolov K.V. and Andriyanova M.S. Signatures of unauthorized persons.
In this regard, I ask:
1) contact the prosecutor of Moscow with a request to protest the illegal court decisions for their cancellation;
2) turn to the chairman of the Moscow City Court and the head of the MV of the MV in Moscow of a working meeting for bringing judges and police officers to strict responsibility, who rudely and systematically violate human rights in relation to foreign citizens.
