At the same time, all victims of the terrorist attack withdrew their claims against the airport after receiving compensation.

The Presidium of the Moscow City Court today satisfied the cassation submission of Deputy Prosecutor General Vladimir Malinovsky and the lawyers of the main owner of Domodedovo Airport Dmitry Kamenshchik and overturned the decision of the Basmanny Court to extend Kamenshchik’s arrest for 3 months and 10 days. “The decision of the Basmanny Court is canceled and the proceedings in the case are terminated,” announced the decision of Deputy Chairman of the Moscow City Court Dmitry Fomin.

On January 24, 2011, in the arrivals area of foreign airlines at Domodedovo International Airport, suicide bomber Magomed Evloev detonated an improvised explosive device. As a result, 37 people were killed and 172 were injured.

The bricklayer and three managers of Domodedovo were accused under Part 3 of Art. 238 of the Criminal Code “Performance of work or provision of services that does not meet safety requirements, resulting in the death of two or more persons through negligence” in connection with the organization of the inspection procedure at the entrance to the terminal. The bricklayer was detained on February 18 this year and placed under house arrest.

The Prosecutor General's Office argued that Kamenshchik's actions did not constitute a crime, that aviation security cannot be considered as a transport service and the victims were not recipients of transport services. The cause of the grave consequences was not the transport service, but the actions of third parties - a terrorist attack, which had already received a legal assessment. The charges against Kamenshchik were brought unfounded, the Prosecutor General’s Office insisted.

Kamenshchik's lawyers also argued that the Basmanny Court, when making the arrest decision, did not check and establish the involvement of the accused in the incriminated actions. They also emphasized that the Mason was not hiding from the court and investigation, and also had no intention of opposing justice.

The investigator in the Kamenshchik case, Sergei Dubinsky, stated that Kamenshchik’s main guilt was his involvement in changing the screening technology at the entrance to the airport terminal. “I personally interrogated the person who was preparing the terrorist attack,” Dubinsky said, “and when I asked why Domodedovo was chosen, he explained that it was there that they entered unhindered, while others were being searched.” The investigator and prosecutors declined to comment on the court's decision.

Domodedovo PR Director Anatoly Khodorovsky said that he was surprised that the investigator once again used the argument about the substitution of security technologies - it is refuted by data about the technology on the Domodedovo website - there is no fundamental difference between them, he insists. According to Khodorovsky, Domodedovo airport was just as affected by the terrorist attack as everyone else. Nevertheless, he went on to create a charitable foundation, which has already provided assistance to 122 victims in the amount of more than 91 million rubles. Six more applications are pending, Jodorowsky said.

The PR director of Domodedovo expects that Kamenshchik could be released today after the Federal Penitentiary Service receives a court decision. In addition, today the Basmanny Court is to consider complaints about the arrest of two other security service workers - Vyacheslav Nekrasov and Andrei Danilov, the decision to arrest whom the Moscow City Court also canceled and returned for consideration to the Basmanny Court.
