Poland is preparing a new constitution

The preparation of the project of the new Constitution became known during the 5th Congress of PIS, which was completed in Warsaw, as a result of which 67-year-old Yaroslav Kachinsky, the permanent leader of the party since 2003, was again elected its chairman. In his speech, he announced that New Poland needed a new constitution, and by namely called opponents of the current government.

Under the flag of sovereignty

Kacinsky called on the Sopartians to “finally get rid of the concepts of the Balcevich pest” (Leshki Balcevich is an economist, the author of economic transformations in Poland in the early 1990s. - NT). He called the “enemy” of Pis, the current head of the constitutional tribunal, whose powers after the victory of the PIS in the elections in November last year, were already cut by a special legislative act. This step of the Polish authorities caused a wide resonance not only in Poland. He was sharply criticized in the EU structures, and deputies of the European Parliament spoke of the “challenging European principles of law”, where the next hearings on the “Polish issue” would be held in July. However, according to Yaroslav Kachinsky, which caused acute discussions the conflict around the powers of the constitutional tribunal actually testifies to the “crisis” of this organ, and if we take it wider - the “crisis situation around the constitution”. According to the leader of Pis, the current constitution “gives a lot of rights, there are articles in it that are doubtful, but there are absolutely important ones that are largely on paper.”

The new Constitution, Kaczynsky said, should "ensure the rights of people, sovereignty (country), determine our relations with the EU." All this, said Kaczynsky, “now”, but there are only decisions of the constitutional tribunal, which are not enough. The tribunal, the leader of Pis emphasized, which, recall, does not occupy any state post, regulates legal issues “not specifically”, gives “too general” assessments that allow you to interpret the basic law differently.

At the same time, Kachinsky did not specify the deadlines for the development of the new basic law, noting only that "work in this direction has already begun."

Commenting, at the request of NT, the initiative of the ruling party about the project of the new Constitution, the Polish publicist and political scientist Jan Hartman noted that there is nothing new in this. " According to him, the sketches of the new Constitution for authorship have been wandering on the Internet since 2010. At the same time, what is formulated in these “sketches” cannot but cause anxiety, Yan Hartman points out: “This is the nationalist-intricate version of the Constitution, which largely dismantles democracy in Poland.”

However, according to the interlocutor of NT, in Poland no one believes that Kacinsky will decide on the screening of the current constitution and to replace the democratic system with the authoritarian: “No one believes in this! Yaroslav Kachinsky recalls Jan Hartman. For many years it has been repeating that his mission is the construction of the "new" Poland. Today, when Pis is again in power, he, of course, again begins to talk about a new constitution.

“To be afraid that Pis will bring his plans to life is not yet worth it,” says Jan Hartman. -This is something like Political Fiction. Yes, the dictator who controls Poland dreams of changing the Constitution, but so far there can be no talk of this, if only because the party standing behind him does not have the constitutional majority in parliament. ”

Nevertheless, in general, the Pis policy vector, according to the interlocutor of the magazine, is alarming for the fate of the Polish reforms. Thus, the ruling party actually authorized the use of citizens for economic needs - we are talking about the so -called “open pension funds”. This money, said Yaroslav Kachinsky, "can become the basis for creating new enterprises, can form an economic policy and support households." Also, according to Jan Hartman, it would not be worth ignoring the clearly designated intention of the authorities to influence the work of the prosecutor's office and courts.
