The court considered the cassation of the prosecutor for the verdict issued in 2010 to a resident of Kamchatka Stanislav Semenov under part 1 of Article 282 of the Criminal Code (excitement of hatred or enmity).
Then Semenov was sentenced to six months of imprisonment conditionally for placing extremist materials on the Internet, including the mentioned cartoon. As noted by the Sova Information and Analytical Center, in August 2014 the cartoon entered the federal list of prohibited materials at number 2030, together with a large number of audio and videos published by Semenov.
"In a cassation performance, the prosecutor asked the verdict to change by excluding the video" Donald Duck and fascism (forbidden series) "from the list of materials recognized as extremist, since this video is the classic cartoon of Walt Disney studio, shot within the framework of the anti -Hitler propaganda company, it contains no calls for extremism or extremism or extremes The propaganda of fascism, the ideology of fascism are shown in a caricature form of anti -Hitler character, ”the court said.
At the same time, it turned out that the examination conducting in 2010 recognized the cartoon with extremist material, not even looking at it. “In particular, from the description of the study, it follows that this audiovisual material contained in the Donald Duck and Fascism file could not have been characterized from a sociological point of view, since the file was not opened for viewing. The case was opened by the prosecutor's office of the closed city according to the Federal SBSB information in the Tomsk region on the placement of materials included in the federal list and prohibited in Russia in the social network.
