In the Primorsky Regional Court, in the re -process in the case of Primorsky partisans, the jury recognized the defendants innocent in the attack and murder of four drug dealers in the Kirovsky district of Primorye, Interfax reports . The jury considered the crime event unproven.
After the announcement, the defendants thanked the jury. The judge said that in connection with the acquittal of the verdict, Alexei Nikitin and Vadim Kovtun are subject to release. Then the journalists were removed from the courtroom.
After some time, Nikitin and Kovtun left the court building. The liberated said that the verdict was a great surprise for them, and the first thing they are going to see their relatives. “I had a life sentence, now I just can’t express feelings,” Nikitin admitted. Kovtun at the court met a wife and daughter.
Three more defendants in this case remained in custody, since they have to serve his sentence on other episodes for which they were previously convicted, lawyers explained.
Meanwhile, the regional prosecutor’s office promised to appeal the verdict, which would be issued on the basis of the acquittal of the verdict, to the Supreme Court.
The discussion of the consequences of the verdict of the Primorsky Kraisud Marina Karakuyan will begin on July 27.
The day before it was reported that the jury did not come to an agreement regarding the verdict to the coastal partisans. Judge Karakuyan handed the jury a list of 20 issues adopted after the discussion conducted by the prosecutor Andrei Cambolin and the lawyers of the Politzeck. According to the regulations, if the jury cannot come to a unanimous decision within three hours, questions are posed to vote, in which none of the assessors can refrain. If the voices are distributed equally, the decision is made in favor of the defendants. The discussion was postponed to Wednesday.
In the debate of the parties and performances with the last word, all the defendants refused to admit sane guilt. The lawyers of the political zones also indicated the insolvency of the prosecution. They noted that the case is based solely on the confession received from the defendants in the investigation, even before the first process in the case. Meanwhile, the defendants have repeatedly stated that these testimonies were given under torture.
In May 2015, the Supreme Court completely abolished the sentences to Vadim Kovtun, who received 8 years of 2 months of a strict regime, and Nikitin, sentenced to a life sentence in a special regime colony. In addition, from the sentences of three more defendants - Alexander Kovtun (younger brother Vadim), Vladimir Ilyutikov and Maxim Kirillov - an episode of the murder of drug addicts committed in the vicinity of the Kirovsky PGT in September 2009 was excluded. The same definition of Kovtun Jr. and Ilyutikov instead of life terms, respectively, was appointed 25 and 24 years of strict regime, and Kirillov reduced the term from 22 to 19 years of strict regime.
Thus, by force, only one person involved in the case entered into a verdict - Roman Savchenko - to whom the episode of the murder of drug dealers did not charged. Politzeka reduced the term from 25 to 24 years of strict regime. Since September 2015, Savchenko, who has no diseases and bad habits, has been contained in LIU -1 in Barnaul - the FSINA hospital for alcoholics, drug addicts and convicted with tuberculosis and AIDS.
Meanwhile, Kovtun Sr. and Nikitin were initially not mentioned among the partisans at all. They were arrested only a few weeks after the defeat of the group.
The repeated process began on March 10 . The jury was formed only on the ninth attempt.
