The accused of the murder of Boris Nemtsov at preliminary hearings in the case in the Moscow District Military Court petitioned for a trial with the participation of the jury. As RAPSI reports citing lawyer Vadim Prokhorov, representing the interests of the family of the deceased, decisions of both this and other stated applications will be made on Tuesday.
The victim, added Prokhorov, supported the petition for the participation of the jury, since such a measure will contribute to fair trial.
Previously, TASS transferred with reference to the lawyer Shamsuddin Tsakaev - defender Zaur Dadaev, the main accused - that the court had already satisfied the petition for the consideration of the case by the jurors. However, this information was not confirmed.
Preliminary hearings in accordance with the Code of Criminal Procedure are held closed. As the correspondent of the "faces" from the court building reported, before the meeting, the police took enhanced security measures. The court of the court was cordoned off, metal fences were exhibited around the perimeter. Police patrols did not miss the journalists to the court.
Opposite the court, several activists of "solidarity" held single pickets. They went out with posters "What are the customers of the murder of Boris Nemtsov", "where are the organizers and customers of the murder of Nemtsov," "Kadyrov for interrogation is a matter for subsequence."
Reporting Dmitry Borco:
In the case, five accused - except for Dadaev, are the brothers Anzor and Shadid Gubashev, Tamerlan Eskerkhanov and Khamzat Bakhaev. Each of them has been charged with points "Z", "s" of part 2 of Article 105 (hiring murder as part of an organized group) and part 3 of Article 222 of the Criminal Code (illegal turnover of weapons). The maximum punishment on the first of these accusations is the death penalty.
The criminal prosecution of another person involved - Beslan Shavanov, who died in March 2015 during a detention in Grozny - was discontinued in connection with his death, that is, on an non -rehabilitating basis. In separate proceedings, the case was allocated against the Kadyrovsets Ruslan Mukhudinov, who calls the accusation the customer and the organizer of the murder, as well as "other unidentified persons."
The lawyers of the relatives of Nemtsov, who were undergoing victims, from the very beginning of the investigation skeptically evaluated his conclusions. In particular, they perceived with distrust of the statement that Mukhudinov was a customer of the crime. According to lawyers, he is a maximum organizer, and then the lower level. Also, lawyers unsuccessfully demanded that the Kadyrovsets Ruslan Geremeyev, whose Mukhudinov worked as a driver, to be prosecuted.
In turn, the accused refused the initial testimony, referring to the torture that they were subjected to after the detention. They stated that Nemtsova shot the late Shavanov, and they themselves were drawn into the crime by deception, without explaining that it was a murder. Dadaev and Eskerkhanov at different times sent complaints about torture and sabotage of their investigation to the ECHR.
