
In the proletarian district court of Tver, during the debate of the author of the film about an attempt to get a job in the police, Shamil Kazakov, the prosecutor requested two years in prison with a sentence in a colony-settlement. The lawyer Svetlana Sidorkina reported this to the Franes.
Kazakov is accused of extremism (part 1 of Article 282 of the Criminal Code) and insulting a representative of the authorities (Article 319). The defendant does not admit guilt.
“I was extremely outraged by the punishment requested by the prosecution. I believe that the prosecution did not prove the guilt of my client. In his actions there is no composition of crimes sane,” the lawyer said. Speaking in the debate, Sidorkina emphasized that police officers are not a social group, since they do not have any general significant social characteristics or status characteristics, which was repeatedly stated by numerous experts with which the courts in other regions of Russia agreed.
"Both the Russian and international law enforcement practice proceed from the fact that representatives of the authorities themselves are not a social group, and not only cannot claim special protection from criticism, but, on the contrary, should be more open to public discussion of their activities. Criminal Cossacks to criminal liability is a restriction of the right to freely expression of his opinion, guaranteed by the norms of Russian and international law," the lawyer said.
At the previous court hearing, a professor at the International Slavic Academy, Associate Professor of the Faculty of Philology of the Nizhny Novgorod State University Elizaveta Koltunova said that the conclusions of the expert’s conclusion, which formed the basis of the charges, "are not always scientifically reasonable."
From childhood, the ethnic Tatar of Kazakov dreamed of working in law enforcement agencies. He graduated with a red diploma of a law university. In November 2014, Kazakov submitted documents to the Ministry of Internal Affairs for Tver for the construction of the district police officers. He went through the necessary tests twice, as a result of which he was recognized as suitable for work in the police. However, in mid -2015 he was refused employment.
Kazakov published on YouTube a video recorded by a hidden camera with an unofficial refusal to accept the service because of his nationality and religion. The film stated that in the Ministry of Internal Affairs of Russia in the Tver region they do not take into the service of "Chechens, Dagestanis, Tatars and Muslims." In February, another video of Kazakov was published. It featured photographs of police officers depicted in Nazi uniforms, and epithets addressed to the head of the personnel service of the Orls of the Tver Ministry of Internal Affairs Alexander Teslenko.
Law enforcement agencies did not make claims to the very fact of the publication of the film, but to "extremist and offensive comments."
The case and the attitude of Kazakov under the 319th article was initiated on March 29 . On May 21, Kazakov was also charged with the 282nd article, after which he was sent under house arrest.
On July 22, the deputy chairman of the Proletarian District Court of Tver Mikhail Bobrov tightened the preventive measure of Kazakov , sending the accused in a pre -trial detention center for a period of two months. The decision was made at the request of the prosecutor. The prosecutor motivated his petition with two circumstances. Firstly, he said, an unknown person repeatedly published on YouTube the first film of Kazakov, remote from the Internet after the initiation of the case. Secondly, from the mobile phone of the sister of Kazakov, according to the prosecutor, the call was made to certain witnesses of the prosecution in order to provide pressure on them.
