
The defendants of the next St. Petersburg case “Hizb Ut-Tahrir” Eldar Ramazanov, Karim Ibrahimov and Ilyas Kagirov at the hearings on the merits of their business, opened on Tuesday, refused to admit guilt. This was reported by RAPSI. The case is considered by the Moscow District Military Court at the exit session in the premises of the Leningrad District Military Court.
As far as it can be concluded from the publication, all three accused were charged with part 2 of Article 205.5 of the Criminal Code (participation in the activities of a terrorist organization), which provides for 5 to 10 years of colony.
The 32-year-old Ramazanov and 53-year-old Ibragimov is charged with the creation of a certain “mediaopis” “Hizb Ut-Tahrir”. In addition, they, according to the plot of the case, opened the Islam in St. Petersburg video channel, through which the anti -constitutional ideas of the Islamic state and the Islamic personality promoted. The accusation of Ramazanov and Ibragimov calls the accusation of the 5th year student of the St. Petersburg Marine Technical University of Kagirov (earlier in media reports he appeared as Kadirov), as well as unidentified persons known by names, in particular some Mustafa and Abdullah.
According to RAPSI, Ibrahimov, after the prosecutor of the indictment, announced the party that the party prohibited in 2003 is called the Hizb Ut-Tahrir al-Islami (Islamic Liberation Party). Meanwhile, the structure to which, according to the accused, he and other defendants belong, is called Hizb Ut-Tahrir. “We are peaceful people. We have no relation to terrorist activity,” Ibragimov assured.
Kagirov also recognized his participation in Hizb Ut-Tahrir. However, as his lawyer noted, the court has yet to establish whether the organization in which the student participated was terrorist.
The proceedings in the case will continue on Wednesday. It is reported that the court intends to sit every day for a week.
During the preliminary hearings, Ramazanov filed a petition for the exclusion from the case of a number of evidence as unacceptable and the termination of the criminal case, as well as to provide a meeting with his wife. In all these petitions, the accused, however, was refused with reference to the fact that they allegedly did not have legal grounds.
The case of Ramazanov, Ibragimov and Kagirov was allocated into a separate proceedings from the common case of Hizb Ut-Tahrir, excited by the FSB in St. Petersburg and the Leningrad Region in May 2014. In total, there are nine defendants. Six of them were arrested in the summer of 2014. These are Ramazanov, Ibrahimov, plumbing Sergey Yablokov and Roman Ivanov, as well as Dagestan Gapur Magomedov and a citizen of Kyrgyzstan, Mahamadimin Saliev, studied at the same university with Kagirov.
In April 2015, Russians Isa Ragimov and Dmitry Mikhailov were arrested, and Kagirov in June of the same year.
The six defendants arrested in 2014, initially, along with Article 205.5, was also charged with 282.2 (the organization of the activities of an extremist organization or participation in it). However, later, as far as you can conclude, this article was excluded from the case. In any case, she was no longer charged with Ragimov, Mikhailov and Kagirov. In addition, she was not discussed in reports of followed sentences.
For today, four people have been convicted of the case. Materials in relation to each of them were allocated into separate production. On August 14, 2015, Saliev was sentenced to five years of strict regime under part 2 of article 205.5; Three days later, on August 17, Magomedov was given five years in common on the same charges. Both defendants concluded transactions with the prosecutor's office and cooperated with the investigation.
At the beginning of this year, sentences were sentenced to Yablokov and Ivanov. To both part 1 of Article 205.5 was imputed, because in the case they appeared as the organizers of the Hizb Ut-Tahrir cell. On March 30, Yablokov received 12 and a half strict regime with an annual restriction of freedom after leaving the deadline. The next day, Ivanov was sentenced to 13 years 4 months of a maximum regime .
It is possible that Yablokov and Ivanov also went on a deal with the prosecutor’s office and their cases were considered in a special order. In any case, about Yablokov, the lawyer reported that his client “admitted and repented”, and the trial of Ivanov, as far as is known, went to one meeting. In addition, both Politsyk received terms below the lower limit: the minimum sanction of part 1 of Article 205.5 is 15 years of the colony.
As the Telegraph reported , on June 10, the Supreme Court confirmed the verdict of Yablokov, rejecting his appeal.
