
The Moscow District Military Court was unable to form a jury in the criminal case of the five accused of the murder of the co-chairman of the RPR-Parnas Boris Nemtsov for the first time. This is reported by Interfax.
“The selection is going on, but today it will not work: out of 59 people, 45 took self -setting up for personal reasons,” said Vadim Prokhorov’s lawyer. “A lot of refusing, it seems to me that people are just afraid of those who are behind this crime.”
The court reported that the selection of a new jury was scheduled for September 28.
On July 26, at the preliminary hearings of the MOVS, he satisfied the defense of the defense of consideration of the jury collegium. The court extended the arrest of the accused before the end of the year.
The MOVS also rejected the petition of the victims to return the case to the prosecutor’s office to retrape the charges from Article 105 of the Criminal Code (murder) to Article 277 (attempt on the life of a public or politician). According to lawyer Olga Mikhailova, despite this refusal, the victims have the opportunity to achieve retraining during the consideration of the case. “It is possible that in the future we will be submitted for retraining. In any case, we intend to achieve this in all possible ways,” Mikhailova said. The lawyer emphasized that under article 105, the minimum sentence is eight years of imprisonment, while in the event of retraining, the accused will not be able to get less than 12 years.
“It is quite obvious that the motive of the murder of Boris Nemtsov was not a household or commercial motive, but the desire to stop his political and social activity. It is article 277 that most accurately reflects the essence of the act of what happened,” said lawyer Vadim Prokhorov. He again emphasized that the victims did not consider the case open, since the organizers and customers of the crime were not found. “The refusal of retraining shows that the authorities do not want to emphasize the fact that Boris Nemtsov was a public and political figure,” Prokhorov added.
In the case of five accused - Zaur Dadaev, the brothers Anzor and Shadid Gubashev, Tamerlan Eskerkhanov and Khamzat Bakhaev. Each of them has been charged with points "Z", "s" of part 2 of Article 105 (hiring murder as part of an organized group) and part 3 of Article 222 of the Criminal Code (illegal turnover of weapons). The first of these charges provides for a penalty up to a high measure.
The criminal prosecution of another person involved - Beslan Shavanov, who died in March 2015 during a detention in Grozny - was discontinued in connection with his death, that is, on an non -rehabilitating basis.
In separate proceedings, the case was allocated against the Kadyrovsets Ruslan Mukhudinov, who calls the accusation the customer and the organizer of the murder, as well as "other unidentified persons."
