The judge of the North Caucasus District Military Court in Rostov-on-Don Vyacheslav Korsakov sentenced the defendant of the first (Sevastopol) case of the Crimean Muslims of 31-year-old Ruslan Zeitullaev by seven years of general regime, and the other three accused-33-year-old Ferat Saifullaev, 40-year-old Yuri (Nuri) Primov and 30-year-old) Rustem Vaitova - to five years of general regime. It is reported by QHA.
All four political zones were declared activists Hizb Ut-Tahrir. However, none of them pleaded guilty.
As Emil Kurbedinov’s lawyer specified on his FB page, a relatively short period appointed to his client, is due to the fact that Korsakov in the sentence re-qualified the prosecution of Politsyk from part 1 of Article 205.5 of the Russian Criminal Code (organization of the terrorist organization) to part 2 (participation in the activities of such an organization), imputed to the rest of the defendants. At the same time, Saifullaev, Primov and Vaitov received the minimum terms provided for in paragraph 2 of Article 205.5.
"This is a small fracture leading to great victories!" - remarked Kurbedinov regarding the verdict Zeitullaev.
The prosecutor in the debate of the parties demanded for Zeytullaev a 17 -year -old regime , for Saifullaev - 8 years in general, for Vaitov and Primov - 7 years of general regime.
As another lawyer Zeytullaev, Eden Semedlyaev, wrote on his FB page, he and his colleagues will appeal the verdict.
At the same time, notes QHA, it is possible that the prosecutor’s office will also be appelier for the decision of Korsakov - due to the relatively soft sentence to Zeitullaev.
Judge Korsakov was part of the board, which a year ago sentenced Oleg Sentsov and Alexander Kolchenko . Whether he conducted a trial in the case of Crimean Muslims alone or at the head of the board, was not specified.
According to Crimea. Realii, the verdict was read in 15 minutes. Obviously, Korsakov limited himself to the announcement of only the resolving part of the decision, lowering the reading of the motivation.
The Political Zyoks to announce the verdict, put on T -shirts with inscriptions. In the glass cage, the defendants were lined up so that the inscriptions on T -shirts, if you read them from right to left, formed in the statement: "The theater is over. The order was completed. Crimean Tatars are banned again." Politzeki seized their mouths with a patch.
All four convicts are residents of villages within the annexed Sevastopol. Builders of Zeytullaev, Primov and Vaitov were arrested on January 23, 2015. The lawyer Kurbedinov noted that previously all three fell into the field of view of the SBU, but no evidence of their unlawful activities was obtained. On April 2, 2015, Saifullaev was detained. The next day he was also arrested.
The investigation led the UFSB in annexed Crimea and Sevastopol . There were 15 volumes in the case. According to his Fabula, Zeytullaev in March 2014 organized in the villages of Orliny, the rear and assault Balaklava district of Sevastopol, as well as in other parts of the city, the Hizb Ut-Tyrir cell for the creation of the Crimean vilayat in Sevastopol as an administrative unit of the world's caliphate. It was claimed, from three of his friends involved in the cell, Zeytullaev demanded the propaganda of the Hizb Ut -Tahrir ideas, to recruit new members, and later organize his own divisions of this structure.
It was reported about Primov that he, unlike other defendants in the case, is not the Crimean Tatar, but the Slav. The media also wrote that in March 2014, Primov welcomed the annexation of Crimea and received one of the first Russian passport.
All four Political Zecks, during the investigation, refused to testify. Zeytullaev did not testify also in court.
The proceedings on the merits took place since the beginning of June . A number of witnesses of the prosecution, acting in the process, abandoned the testimony given at the investigation .
On August 31, speaking with the last word, the defendants announced the political motivation of the case . Saifullaev noticed that from the Crimean Tatars after the annexation of the peninsula "they began to make enemies of the people."
The defense noted that Korsakov led the court with a mass of procedural violations. In particular, he imposed on each of the defendants of state lawyers, although each of them has lawyers by proxy. In addition, Korsakov crossed the trial, departing from the order approved by himself during the preliminary hearings.
