The Moscow City Court rejected the appeal of the swamp prisoners of Dmitry Buchenkov and Maxim Panfilov to extend his arrests. This was reported from the courtroom of the "faces".
The defendants participated in a meeting on video communication from different pre -trial detention centers. It was noticeable that the health status of Panfilov, suffering from Tourett's syndrome, noticeably and unexpectedly worsened since the last court session. "In" Butyrke "tablets are given either, they don’t give me, the medicines are needed urgently, I ask you to come to me or a lawyer," the political prisoner said.
Lawyers asked to release a seriously ill Panfilov under house arrest. The defender noted that the arrests of swamp prisoners violate Article 3 (prohibition of torture), 5 (the right to freedom and personal integrity) and 11 (freedom of assembly and associations) of the European Convention on Human Rights.
Lawyers recalled the decision of the ECHR in the Frumkin case against Russia, in which the court actually entrusted the police for everything that happened in Bolotnaya.
Lawyer Sergei Panchenko said that on October 5, a meeting of the Presidium of the Supreme Court was scheduled, at which decisions on the arrests of former swamp prisoners Artem Saveelov, Leonid Kovyazin and Ilya Gushchina in connection with the decisions made on their complaints of the ECHR will be most likely to be abolished.
However, the Moscow City Court did not take these arguments into account and recognized the extension of the arrests of Buchenkov and Panfilov.
On August 29, the judge of the Basmanny District Court of Moscow Arthur Karpov extended the terms of detention in the pre -trial detention center until December 2, 2016 and January 7, 2017, respectively. Karpov examined the relevant petitions of the investigator of the Investigative Committee of the Investigative Committee of the Investigative Committee of the Investigative Committee of Alexander Uranov, who conducts the affairs of both political zones. During the hearings, it turned out that the investigation in the swamp case was extended until March 6, 2017, that is, up to 4 years 10 months from the date of the rally in Bolotnaya.
On August 26, Panfilov was transferred to the capital's pre-trial detention center-2 Butyrka at the end of a stationary psychoexpertiza at the Institute. Serbian.
The 37-year-old associate professor of political science and a member of the left movement of Buchenkov has been in jail since December 2015, 30-year-old resident of Astrakhan Panfilov since April 2016. Both of the accused are charged with the standard part 2 of Article 212 of the Criminal Code (participation in the riots) and part 1 of Article 318 (the application of non -hazardous violence to a government representative).
At the same time, Buchenkov did not participate in the march of millions on May 6, 2012 at all - he was outside Moscow and returned to the capital only on the evening of that day. However, as the lawyer of Politzek Svetlana Sidorkina told the “faces”, investigator Uranov refused to introduce to the case the photos of an unknown citizen, whom the Investigative Committee presents for Buchenkova. In these pictures, it is clear that Buchenkov and a citizen with Bolotnaya are different faces.
Neither Buchenkov nor panfils admit sane guilt.
