
The Supreme Court of Russia upheld the decision on the ban on the Majlis of the Crimean Tatar people as an extremist organization. This was reported by "Crimea. Realities." The appeal served by the Mejlis is rejected. The decision of the Supreme Court of the annexed Crimea entered into legal force.
The senior prosecutor of the Crimean prosecutor’s office, which was controlled by Russia, Vladimir Chukhrin, at the hearing, argued that "the activities of the Mejlis poses a threat to the security of the state and society." He accused Majlis of organizing a rally by the Verkhovna Rada of Crimea, after which the “case on February 26” , “riots” on the border with the continental Ukraine, which served as a reason to initiate the falsified“case on May 3” , as well as in the civil blockade of the peninsula, was fabricated.
Lawyer Marina Agaltsova and lawyer of the Memorial human rights center Kirill Koroteev, representing the interests of the Mejlis, indicated the illegality of the prohibition of the Crimean Tatar National Executive Committee. Firstly, Korotheev emphasized, Medzhlis is not an NPO - his activity is “regulated by Article 5 of the UN Declaration on the Rights of Indigenous Peoples, which provides for the right of indigenous peoples to maintain and strengthen their special political and legal institutions.”
Secondly, there was a violation of the jurisdiction of the case of the prohibition of the Mejlis. Its bodies work on the territory of Ukraine, where Russian anti -ethnic extremist legislation does not apply.
However, the Russian Supreme Court ignored these arguments.
Agaltsova and Korotheev intend to appeal the decision on the ban and the adopted appeal definition in the ECHR. “Further appeal to the Presidium of the Supreme Court is technically possible, but the Presidium is so rarely listening to non -university things that there is probably another hearing,” Koroteev remarked. “And, accordingly, the natural course of events is further - this appeal to the European Court of Human Rights. This is the advice that we will give to our principals.”
The members of the Majlis themselves did not participate in the consideration of the appeal. On Thursday morning, the first deputy chairman of the Crimean Tatar National Executive Committee, Nariman Jael, published a statement by Medzhlis members at his FB page, in which non-participation in the meeting was presented as a "demonstration of a clear political position."
"By our absence in the Supreme Court of the Russian Federation, we demonstrate our disagreement with the right of the Russian authorities to prevent (prohibit) the activities of the representative body of the indigenous Crimean Tatar people chosen by the people; its absolute distrust of the Russian justice, which has repeatedly shown readiness, violating Russian legislation itself, to participate in political persecutions organized by the authorities; Political prisoners, which have become victims of Russian "justice," the document said.
Meanwhile, in Kiev on Independence Square on Thursday morning, a protest was held against the ban on the Majlis, in which several dozen people took part. They went out with the poster of the "fence of Medzhlis = fence to the people."
According to UNIAN, at a rally, among others, the press secretary of the Ukrainian Foreign Ministry Maryan Bets spoke. She called the Majlis ban "a crime in a chain of crimes of the Russian Federation against Crimea, against Ukraine."
The decision on the ban on the Majlis was issued on April 26 by the collegium of the Supreme Court of Crimea, chaired by Natalia Terentyeva, in a lawsuit filed by the then Russian prosecutor of the region Natalya Poklonskaya.
During the hearings, Poklonskaya said that "all the activities and ideology of the Mejlis is built only on one - on the fight against Russia ." The official called the leaders and members of the Mejlis "puppets in the hands of large western puppeteers." “Majlis is needed only for inciting rods, hatred, enmity,” she said.
The decision was made with a mass of procedural violations. Thus, the judicial collegium attached to the case the materials of 1988 , when the Mejlis did not exist at all - it was formed on July 6, 1991.
The ban on Majlis caused protests of the international community. In particular, on May 12, the European Parliament adopted a resolution with the demand to immediately cancel this decision .
Meanwhile, this week, the Russian authorities of Crimea began to pursue members of the Mejlis, as well as delegates of the Kurulti of the Crimean Tatar people working on the peninsula. A number of politicians and activists were summoned to a survey in the CPE.
The security forces were interested in the circumstances in which the Majlis decided to suspend the membership of three collaborators on September 22: the mufti of Crimea Emirali Ablaev, the press secretary of the muftiyat Ayder Adjimambetov and the deputy head of the Russian administration of the Simferopol district Ruslan Yakubov, as well as the removal of Adjimambetov from the post of deputy Medzhlis.
On September 27, in the Bakhchisarai Police District, in the presence of TSPE operatives, a protocol was drawn up on a member of the Mejlis Ali Hamzin. He was charged with part 1 of Article 20.28 of the Russian Administrative Code (participation in the work of a public association, whose activity was suspended). On the same day, Khamzin was fined 1000 rubles .
On Wednesday, in the same district department, the Major of the G. Levifabricated the same protocol on the deputy chairman of the Mejlim Ilmi Umarov, who was under investigation in the separatism case and recently freed himself from a psychiatric hospital , where he was unreasonably placed for three weeks for a stationary examination. Later on August 28, the judge of the Bakhchisarai district court, Alexander Skisov,fined a policy of 750 rubles.
