Ildar Dadin's lawyer sent a complaint to the ECHR

The defense of Ildar Dadin, convicted under the article of repeated violations of the procedure for holding a rally, sent a complaint to the European Court of Human Rights.

Novaya Gazeta reports this with reference to lawyer Ksenia Kostromina. As lawyer Ildar Dadina noted, the complaint points to violations of three articles of the European Convention on Human Rights by the Russian authorities: the right to freedom of assembly and association (Article 11), the right to a fair trial (Article 6), the right not to be tried or punished twice (Part 1 of Article 4 of Protocol No. 7).

A criminal case under Article 212.1 of the Criminal Code (repeated violations at rallies) was opened against Dadin on February 2, 2015, after he served 15 days of administrative arrest following his arrest on Manezhnaya Square on January 15. On December 7, 2015, Dadin was sentenced to three years of actual imprisonment.

Article 212.1, which provides for a punishment of up to five years in prison after four decisions made in six months under Article 20.2 of the Code of Administrative Offences, was included in the Criminal Code in the summer of 2014.
