The head physician was fined for failure to provide information at a lawyer’s request

On October 6, 2016, the justice of the peace of court district No. 2 of the Central District of Chelyabinsk found Anatoly Kosov, chief physician of the Regional Clinical Specialized Psychoneurological Hospital No. 1, guilty of “refusal to provide information” to a lawyer (Article 5.39 of the Code of Administrative Offenses of the Russian Federation) and fined him 1,000 rubles. This was announced by lawyer Andrey Lepekhin, who defends civil activist Aleksey Moroshkin, who is accused of vandalism, who is being held in a mental hospital.

The head physician did not respond within the 30-day period established by law to the request of Lepekhin's lawyer to provide medical documentation in the Moroshkin case, did not send a notice of refusal to provide information or a notice of a delay in its provision, the judge pointed out.

In November 2015, Aleksey Moroshkin was found guilty of inciting to violate the territorial integrity of the Russian Federation for posts on the social network about the Ural Republic and applied compulsory medical measures to the activist. Then law enforcement agencies opened a criminal case against Moroshkin under the article “Vandalism” (part 1 of article 214 of the Criminal Code of the Russian Federation). According to investigators, last year the activist painted a bust of Lenin in Chelyabinsk in the colors of the Ukrainian flag. The materials on this case were returned to the police for additional investigation.

In June of this year, lawyer Andrey Lepekhin filed a lawyer's request addressed to Anatoly Kosov, chief physician of the Regional Clinical Specialized Psychoneurological Hospital (OKSPB) No. 1, to provide Moroshkin's medical documents. Kosov ignored this request. The official allowed inaction, noted the prosecutor's office of the Central District of Chelyabinsk.
