
The Ministry of Justice developed a draft amendments to the Criminal Code, which allow us to attract convicts to work at the facilities of state corporations and state -owned companies. It is reported by RBC.
We are talking about convicts to mandatory, correctional and forced labor. The amendments are made to Articles 49, 50 and 53.1 of the Criminal Code, which regulate the serving of these types of punishments.
Regarding mandatory and correctional labor, it is said that the list of objects to which the convicts will send is established by the government. As for compulsory work, it is proposed to resolve their serving outside the correctional centers, but only at objects that have specially equipped hostels. Thus, there are no obstacles to the sending convicts to the objects of state corporations and state -owned companies, provided that there are no specialized hostels there in this case.
Mandatory work is carried out by convicts in their free time from the main work. The objects of work are determined by local authorities in agreement with the penal inspection. As a rule, convicts fulfill the duties of orderlies, janitors, marigolds, etc. The duration of compulsory work is from 60 to 400 hours; At the same time, a citizen cannot be attracted to them for more than 4 hours a day.
The convicts are serving at the main place of work. If a citizen is not employed, local authorities send him to an object selected in agreement with the UII. In this case, the object should be in the area of the residence of the convict. The duration of corrections is from two months to two years. During the serving of the sentence from the salary of convicts, he is held in state revenue from 5 to 15 percent.
Forces are introduced in Russia from January 1, 2017 as an alternative to imprisonment for crimes of small or moderate gravity or serious crimes committed for the first time. According to the current legislation, convicts for such punishment must live in correctional centers.
As the teacher of the Economic Power of Moscow State University Olesya Kostenko, specializing in the study of the FSIN economy, noted RBC, the use of the labor of convicted at the facilities of state corporations and state -owned companies will significantly reduce the cost of the cost of work, since salary expenses amount to 65 percent of the costs of any large construction. At the same time, the effectiveness of such a scheme for the state is not obvious. Firstly, the expert explained, it is not clear whether the FSIN will receive money for providing labor. Secondly, it is unclear how many people can be involved in work at these facilities: not every convicted person is able to physically endure it.
In addition, Kostenko added, convicts will receive a salary below the market for their work, which means that the Ministry of Justice project "brings a legal framework to the desire to operate labor resources." "Until the moment the labor of prisoners is regulated by the criminal -executive, and not by the Labor Code, all initiatives in this area are attempts to find ways to operate the labor of convicts," the expert emphasized.
In May 2015, the State Duma deputy, Uneneros, AlexanderKhinshtein, prepared a draft amendments to the PEC , allowing employees to be employed by citizens convicted of forces and to deadlines in colonies-settlements, at enterprises far from correctional centers and colonies within the region of serving the sentence. In particular, Uneneros proposed using the work of convicts at construction sites for the 2018 World Cup and in the forest industry.
The first deputy director of the FSIN Anatoly Rudy approved the initiative. According to the jailer, the idea was supported by the then Ombudsman Ella Pamfilova.
In July 2014, the deputy director of the FSIN Oleg Korshunov said that during the construction of the bridge across the Kerch Strait, the work of prisoners will be used. “It will be necessary to do reinforced concrete, engage in metalworking,” said the FSINovets. “We are able to help and expect that there will be large orders, therefore we intend to connect the colony of the whole south of Russia to their implementation.”
Korshunov added that about 200 prisoners of the colonies-settlements are already involved in the improvement of the surroundings of Sochi after the Olympics. At the same time, he admitted, the earnings of the convicts below the minimum wage.
In May of this year, the order of public procurement was published on the "provision of labor of convicts" for the construction of a new pre -trial detention center in annexed Simferopol. The customer was the 23rd construction department of the FSIN. The work required 60 convicts. The period of delivery of the "goods" was indicated by May - December 2016. The maximum price of the contract and the contractor were not specified.
