
Judge of the Presnensky district court of Moscow Evgeny Naydenov tightened the nationalist Dmitry Demushkin’s preventive measure in the case of extremism, sending the accused for house arrest for two months - until December 21. It is reported by "Mediazona".
Naydenov ordered Demushkin not to leave apartments in the South Moscow district of Bratevo, not to use communications and not communicate with journalists.
The decision was made at the request of the investigator of the Investigative Committee, whose surname was not indicated in the publication. The investigator stated that Demushkin has repeatedly violated the recognizance not to leave him after the initiation of the case. In particular, in a petition, the politician, despite the subscription, went to Astrakhan. The prosecutor supported the arguments of the investigator.
Demushkin objected that the request for a trip to Astrakhan submitted to the judge of the Nagatinsky district court of Moscow Eleanor Vanina, who considered his case before returning to the prosecutor’s office, and Vanina gave appropriate permission. The actual reason for the application of the investigation was the politician named the authorities to disrupt his participation in the Russian march, traditionally planned on November 4. Demushkin suggested calling Vanin, who had already resigned from the court, to the meeting with a witness.
Lawyer Mikhail Tikhonov supported his principal.
The judge, however, indicated that Demushkin left Moscow unauthorized. Permission to leave the capital, explained Naydenov, the politician had to receive from the chairman of the Nagatinsky district court Anna Kobylenkova. Meanwhile, Kobylenkova, in response to the request, stated that she did not give such permission to the accused.
After the decision is announced, Demushkin assured that his colleagues would hold a Russian march without his participation.
Demushkin was detained on Friday in the morning immediately after he submitted a notification to the Russian City Hall about the Russian march. Immediately after this, the policy was taken to court.
The case against Demushkin became known in December 2015 . Part 1 of Article 282 of the Criminal Code (excitement of hatred or enmity), the policy threatens up to four years in the colony. Hearing on the merits began on May 6 . Vanin illegally closed the process from the public. The prosecutor in the debate requested two years of real term for Demushkin. However, on June 14, Vanina returned the case file to the prosecutor’s office , referring to the inability to establish the guilt of the defendant.
