The baby is dead, there are no guilty

The Investigative Committee of St. Petersburg "due to the lack of corpus delicti" terminated the criminal case of the death of the Tajik boy Umarali Nazarov , instituted under the article "Causing death by negligence." This decision was made a year and seven days after the tragedy. In mid-October 2015, the five-month-old Umarali Nazarov was separated from his mother, 21-year-old Zarina Yunusova, detained on October 13 for violation of the migration regime. A little later he died in the hospital.

The five -month -old Umarali did not become 10 hours after the house with his family, the scene quite familiar today was played in the house where he lived with his family: when the father of the child Rustam went to work, an employee of the Migration Service of the Admiralty district of Panakhov called the door - he had information that illegal migrants live in the apartment. Suspicions were justified: registration with Zarina Yunusova, mother wise, was long overdue. Later, her husband Rustam explained that the registration was over when Zarina was already pregnant, and the young woman was just afraid to leave for Tajikistan in this state and remain there alone, without her husband. The UFMS officer called the police, the arrivals of the police took Zarina with the child and Daler - the minor brother Rustam, who was also at home that morning. For some reason they took it so hastily that they did not even let Zarina put a hat on the child.

While at home at Zarina, an employee of the Migration Service of the Panakhs could not help but see how she feeds and puts on a child, nevertheless, a protocol was drawn up in the police that a hopeless child was found in the house on Lermontovsky Prospekt - the document is obviously false. Moreover, both the father of the child Rustam and Grandmother Mikhriniso with a medical card Umarali soon arrived in the police department, from which it followed that he was observed in the district children's clinic. They also brought a birth certificate and other documents proving that his mother was Zarina, dad is Rustam, and his grandmother was Mikhriniso. And she, her grandmother, has in perfect order, so she can immediately pick up the Umara on legally.

But they did not give her a child, without even taking a bottle with a warm milk mixture. The inspector for minors took the child from Zarina’s mother and called an ambulance, the arrivals of the doctors took away the Tsymbalin hospital, contemptuously throwing her grandmother so that she would not worry - they will follow the child 20 times better than at home. In the late evening of the same day, the boy died.

Parents (Zarin after drawing up the protocol were released after a few hours) called only in the morning. When they rushed to the Tsymbalin hospital, there was no grid in the hospital morgue - he was taken to the central morgue. But there Rustam and Zarin showed the remains of their son only on the fourth day. Together with his parents in the morgues, Masks ran, Uncle Rustam-he speaks Russian best in this family, and this is what he told a few days after they allowed him to look at Umarali:

- They did not allow us to see him in the morgue, and when they gave it, everything was already gutted there - both the brain and the insides. Around the eyes there was everything blue, and half of the body is blue, and half of the face in the blood is around the nose and mouth. I don’t know what they did to him - they said, maybe they gave him oxygen, therefore blood. And I think he was dropped. Or maybe they specially took it to the authorities.

Immediately after the death of the boy, the Investigative Committee opened a criminal case. At the same time, checks were scheduled for the employees of the Federal Migration Service-whether their actions were legitimate, and in relation to the police-whether they acted correctly by taking the child from the mother due to the lack of registration from her. Both the actions of the migration service and the actions of the police were recognized as correct and legal - within the framework of the standard procedure. In the actions of the doctors of the Tsimbalin hospital, they also found nothing wrong.

The conclusion of the city bureau of forensic medical examination states that the death of the Umarali was to blame for the “generalized viral (cytomegalovirus) infection”, which has long developed and impressed almost all the vital organs of the respiratory, heart and gastrointestinal system of the child. The parents of the child and all his relatives, who watched him daily, unanimously claim that they were growing a healthy and calm child, on the day when he was taken from his mother, he did not even have a cold. This is what Rustam Nazarov says:

“He didn’t even cry with us, as he cry, feed him - and he immediately calms down.” He was not sick with a flu, nothing.

By the way, both the ambulance doctors, and the doctors of the Cymbalin hospitals, also during the examination did not find any ailments in him. Neither parents nor civilian activists who went out with posters to the hospital, to the police department, the Federal Migration Service and the Investigative Committee, demanding a fair investigation of this case, do not believe in the deadly megalovirus. Rather, it is assumed that death occurred as a result of careless feeding - the milk mixture was unusual, the child could burst and suffocate.

Uncle Rustam recalled masks that immediately after the tragedy, journalists began to go to them and many tried to present the case so that the family lived in a dirty and cold basement, unsuitable for housing. Masks were indignant for nothing in vain: the apartment where they were growing up was, of course, without European -renovation, but it was warm, light and clean there. However, the family still had to move out from there-apparently, some local bosses were unhappy with the scandal and made it clear that it was better for migrants to get out of here.

And soon, despite the request of the lawyers to allow the mother to wait for the court, Zarin was expelled from Russia - she left with the body of her baby. In Tajikistan, she was promised to conduct an independent examination, but this was never done.

Rustam remained in St. Petersburg, and in the end he was nevertheless recognized as a victim. Lawyer Olga Zeitlina believes that the removal of a child from Zarina was completely illegal.

- Article 2 of the Constitution of Russia, the right to life, as well as the right to family life, was violated, since there were no reasons for the separation of the mother and infants. They were told that they have disinfection, and it is dangerous for the child to stay in this room, but what kind of disinfection it is and why matter could remain there, but the child is not, it is not clear. In general, we believe that there is a concealment of a crime - no investigation was carried out on the actions of the police and the FMS. From the very beginning, it was clear that they would not deviate from the conclusions of the forensic medical examination. There was also an examination of the Military Medical Academy, but there is no research part, the applied methods are not indicated. It is also interesting that in a child’s medical record on a page where there are notes made on the last day of his life, there are scuffs noticed by the naked eye.

The defense demanded another examination, but Olga Zeitlina was right in her assumptions: this examination also did not give anything new - otherwise, the conclusions of the two expert commissions would have to question.

- But even if it is Megalovirus and Paragripp, with which we disagree, then no decision was made by the actions of the FMS and the police.

Olga Zeitlina does not hope for Russian justice, nevertheless she is ready to go through all the authorities and reach the European Court of Human Rights, although it will be aware that this will be very difficult.

The death of Umarali did not stir up Petersburg - not angry crowds, but only a few activists went out into the streets. Later they united in the Civil Committee "Remember Umarali."

These people support the Umarali family, help Rustam get acquainted with documents. Together with him, they studied the conclusion of a new medical examination - and found a lot of strange there. For example, they cannot understand why there are no video recordings in boxing No. 5 of the Cymbalin Hospital from 17.35, when feeding took place, up to 0 hours 5 minutes, when Umarali was found lifeless. What happened to the child at this time is unclear. Civil activist Tatyana Dolinina , a biologist by education also has many questions.

- The termination of the criminal case upset me, but it was not at all surprised - this should be expected. No one wants to plead guilty, and all the links of this chain are tied to each other and act as a united front. Here everyone is to blame, starting with an official of the migration service, who recorded the abilities of a child taken from his mother. And if one link sprinkles, and everyone else is sprinkled, they cannot allow it. But what is important: in Tajikistan they examined the mother of Umarali and she did not find cytomegalovirus, and if the nursing mother was not infected, then the baby was not infected, this simply cannot be. And you also need to deal with the hospital of Cambalin, she needs a overall test. I have information, however, not from the official source that there are sharply lacking staff, one sister for 8 boxes, or even 10, so there are simply no one to look at the children. And there were stopped letting volunteers, it is clear, because volunteers are anxiety for the leadership of the hospital and the leading of a litter from the hut.

All this year, the Umaral was followed by the deputy of the Legislative Assembly of St. Petersburg Boris Vishnevsky , repeatedly with his colleague Alexander Kobrinsky, who made requests on this occasion - both to the prosecutor’s office, and the Investigative Committee, and to the city administration. He considers the closure of the criminal case another link in the chain of circular bail and the desire of the guilty in the death of the boy to avoid punishment.

- I am well acquainted with the circumstances of this case and I can confidently say that at all stages of the situation that led to his death, very serious violations were committed. The police had no reason to take the mother and the child to the department, the protocol on an administrative offense could be drawn up in place. The department had no right to take away the child from the mother, declaring him lost and abandoned, since his mother was nearby, and the father and grandmother with documents. If the Tsimbalin hospital could not determine that the life of the child is at risk, then this means that there are completely incompetent doctors, and if he did not have such a condition, this means that the child was abandoned without any help, and it is not clear what led to his death. That is, the boy died, but for this they do not want to hold anyone accountable, it was obvious from the very beginning. I consider the termination of the criminal case unreasonable from a legal point of view, and from human - monstrous and immoral: it turns out that no one is responsible for the death of the child.

- Why did St. Petersburg be indifferent to the death of Umarali?

- Well, not the whole of Petersburg - those who go to the Solovetsky stone to recall Anna Politkovskaya, those who go to the marches against hatred, who protest against the non -inflated war in Ukraine, were not indifferent. But in general, the state of our society is such that even such an event as the death of a baby is not able to stir him up, to make him horrify. Although, of course, this story did not have the publicity that it was supposed to have - and thanks to those media that illuminated it.

Vishnevsky also notes bitterly that the death of Umarali Nazarov did not excite Petersburg deputies - except Alexander Kobrinsky, although they all love to advocate motherhood and childhood, for the rights of children and mothers. Solds Boris Vishnevsky and the fact that one of the reasons for such indifference may be the national belonging of the deceased boy and his parents - perhaps if they were Russian, there would be more resonance. Since the criminal case was closed by the St. Petersburg Investigative Committee, the deputy considers it possible to appeal this decision in the Investigative Committee of the Russian Federation.
