The IK-22 administration in the village of Lepley of the Zubovo-Polyansky district of Mordovia lifted the anarchist Ilya Romanov, who was serving a nine-year term in the terrorism case, from a preventive accounting, which he was previously put as an extremist. This was announced on Saturday by the Right -Russian Site Coordinator of the Russian Verdict human rights center Alexei Baranovsky with reference to Evgenia Gubin, Politzek’s lawyer.
“Well, there are small legal victories in the struggle of citizens for their rights today,” the human rights activist commented on the news.
In the response of the FSINITS to the request of Gubin, however, it is not explained whether Romanov was removed from the professional accounts in pursuance of a court decision or for any other reason.
Romanov was registered in December 2015 , when he was still in the pre-trial detention center-1 in Nizhny Novgorod. The only reason for this was the sentence to Politzek on the "terrorist" articles of the Criminal Code.
The activist appealed the decision, however, the Soviet District Court of Nizhny Novgorod on May 16, 2016, after the delivery of Politzek to the colony, announced the actions of the FSINITS as legitimate. At the same time, in the court decision it was stated that the statement on a professional science was not associated with additional restrictions for the prisoner. “Although we know that this is not so,” said Baranovsky.
In particular, paragraph 25 of the Ministry of Justice of the Ministry of Justice for the prevention of offenses and convicts adopted in 2013 allows the FSins to isolate the prisoner, who stands on vocational school as an extremist, "from the connections and conditions that have a negative impact on him." “That is,” the human rights activist explained, “to actually tighten the regime of the detention without a court decision and without any violation by the concluded regime of a correctional institution.”
At the same time, Baranovsky emphasized, the decision refers to the non -existent law - “On countering extremist ideology” (correctly - “On Combating Extremist Activities”). “This could be attributed to a typo, if it were not for the fact that in his statement of claim Ilya Romanov emphasizes that the concepts of“ extremist ideology ” - for which he was put on“ preventive accounting ” - does not exist in the legal field of the Russian Federation, and therefore it is not possible for what legally does not exist!” - continued Baranovsky. However, the court, refusing to consider this argument of Politzek on the merits, referred to the law that is not.
After that, Romanov appealed to the Nizhny Novgorod Regional Court. On August 31, the case was solved in his favor - the production of vocational school was recognized as illegal. However, Baranovsky noted, such a decision was made exclusively on a formal basis. “On the“ professional science, ”the human rights activist explained,“ he was set as a person “prone to”, and it is necessary to put according to the Ministry of Justice of the Ministry of Justice that they are not “prone to”, namely that “professors and distributing extremist ideology.” In general, they put it in a general way. ”
Thus, "the most curious in this dispute is yet to come," Baranovsky concluded in September, commenting on the decision of the regional court. “After taking the“ wrong ”accounting,” the human rights activist explained, “(Romanova. - Ed.) They can impose accounting“ Correct ”.
At the same time, the leader of the “Russian Verdict” noticed that Romanov’s complaints actually dispute as the non -controversial provisions of the Ministry of Justice instructions. Therefore, in the event of Romanov’s staging, the Politzek has reasons to apply to the Constitutional Court on the “right” professional study, Baranovsky pointed out.
Nizhny Novgorod Romanov was arrested in the fall of 2013 after an unsuccessful experiment with pyrotechnics, as a result of which he lost his left hand. Along with the attempt on the Romanov terrorist attack, preparation was charged with justification of terrorism. Politzek himself pleaded guilty only in the illegal storage of explosives and the illegal turnover of ammunition.
Since April, when the activist arrived in IK-22, the FSINITS arranged a number of provocations against him; As a result of one of them, in early May, he was sent for 14 days to a schizo. Romanov was also threatened by a transfer to Bezun (a detachment of strict conditions for serving a sentence) and EPT (a single chamber -type premises - an internal prison of a colony).
In early August, the mother and stepfather of the left activist Larisa Romanova, the former wife of Politzek, were detained by mail in Moscow when they sent him a money transfer to the colony - 1,500 rubles. The police themselves called the police themselves, finding out that Romanov was included in Rosfinmonitoring in the list of terrorists and extremists.
In the OP of the Chertanovo Central, the detainees forced to inform the names, names and patronymics of all their relatives, threatening that in case of refusal they would be engaged in the CPE.
