The ECHR communicated the complaints of Gushchin and Gaskarov

The European Court of Human Rights (ECHR) in Strasbourg communicated the complaints of Aleksey Gaskarov and Ilya Gushchin, who served their sentences in the Bolotnaya case, reports . RAPSI

The ECHR sent questions to the Russian authorities on the complaints of Ilya Gushchin and Alexei Gaskarov. In addition, the Russian authorities have been given the opportunity to supplement the information already submitted to the Strasbourg court on the complaints of other defendants in the Bolotnaya case: Vladimir Akimenkov, Leonid Kovyazin, Stepan Zimin, Denis Lutskevich, Yaroslav Belousov and Andrey Barabanov.

In all pending complaints, the court is interested in the question of whether the arrest of the applicants and the initiation of criminal proceedings against them can be regarded as an attempt to interfere with the exercise of their right to freedom of assembly.

With regard to Gushchin's complaint, the Strasbourg Court is also interested in whether he was found guilty and re-convicted in Russia for an offense that is prohibited by Article 4 of Protocol 7 to the European Convention on Human Rights.

According to Gaskarov, the ECtHR is interested in how his rights guaranteed by Article 3 of the convention were respected, given the conditions of detention during the hearings in court. In addition, the authorities will have to answer the question of how fair the trial in Gaskarov's case was.

The European Court of Human Rights has published judgments in the cases of Ilya Gushchin and Alexei Gaskarov. The court agreed that in Russia Gushchin and Gaskarov's right to freedom of assembly was violated, and Gaskarov was sentenced twice for the same reason.

Both defendants in the Bolotnaya case were awarded ten thousand euros in compensation. In addition, Aleksey Gaskarov was ordered to pay eight thousand euros for legal costs.
