Rosneft, in the office of which there was a transfer of a bribe of $ 2 million to the Minister of Economic Development of the Russian Federation Alexei Ulyukaev, did not interest investigators involved in this case.

According to TASS, Ulyukaev is the only suspect on the grounds of the crime under Part 6 of Art. 290 of the Criminal Code ("receipt of a bribe"). “There are no other defendants in the case yet,” the agency’s source said.

In addition, as the representative of the IC of the Russian Federation Svetlana Petrenko said, the investigation has no questions to the very transaction for the sale of a share in the Bashneft company Rosneft, in which a bribe took place. According to her, the acquisition of shares is not an investigation subject.

It should be noted that the wiretap of Ulyukaev’s telephones, according to the results of which “operational-technical measures” were held with a giving bribe with the direct participation of the head of the Rosneft Security Service Oleg Feoktistov (he also oversaw the ex-governor of the Kirov region Nikita Belykh), coincided with Ulyukaev’s sharp performances against the participation of Rosneft. privatization "Bashneft".

New victim "Curses of Bashneft"

The observers have already connected the current arrest of Ulyukaev with the "curse of Bashneft." Ulyukaev is not the first to fall under the investigation of law enforcement agencies in connection with the sale of Bashneft. The first, back in April 2014, was the son of the President of Bashkiria Murtazi Rakhimov Ural, who, according to investigators, illegally privatized the company, and then illegally sold it to the AFK System Vladimir Yevtushenkov. But the investigation failed to get the son of Rakhimov from Austria, where he lives. He is put on an international wanted list.

Thus, until that moment, Yevtushenkov was the most famous victim in the Bashneft case. He spent three months under house arrest after criminal proceedings against him in 2014, but then he was recognized as a conscientious buyer, and the case was closed in January 2016.

AFK "System" bought Bashneft shares from funds that were close to the then head of the Republic of Murtase Rakhimov and his son. In October 2014, the Moscow Arbitration Court found that the privatization of Bashneft was carried out with violations, and decided to demand the shares of the oil company near the System. In December, the AFC transferred Bashneft to the state, and in February 2015, through the court, it recovered 70.7 billion rubles from the Ural Invest, the seller of the asset, a structure close to the Urals Rakhimov. In March, the parties concluded a settlement agreement: Ural-Invest paid the system of 46.5 billion rubles, and she pledged to invest 4.6 billion rubles from the funds received in the Urals Foundation (owns 100% of the Ural Invest).

Rosneft's privatization transaction may be at risk

Due to the arrest of Alexei Ulyukaev, the Rosneft privatization deal, scheduled for conducting before the end of 2016, may be in jeopardy.

According to TASS, referring to the report of the analysts of the Aton investment company, Ulyukaev plays one of the key roles in the privatization of Rosneft (19.5%), so his arrest may jeopardize the closing of the transaction before the end of the year. "

Analysts "Opening of Capital" also expressed the opinion that the Rosneft privatization transaction may slow down, since the Ministry of Economic Development is a key ministry for this process. The market is now not in the best condition, and the plank for this transaction was established rather high. And it is not clear how the Ministry of Economic Development will act in the near future.

Earlier, Prime Minister Dmitry Medvedev expressed the hope that the privatization transaction of 19.5% of Rosneft will be able to complete before the end of the year.

Initially, the amount that it was possible to help out from the sale of these shares was estimated at 500 billion rubles, then at 650 billion rubles, then - at 700 billion. Recall that the company is in state property indirectly - 69.5% of Rosneft's securities belongs to Rosneftegaz, which the state owns.

On November 12, the government amendments to the bill, according to which Rosneftegaz is exempted from income tax from the sale of 19.5% of Rosneft shares, received support from members of the State Duma Committee on Budget and Taxes.

Rosneft completed the case of an attempt to borrow 1.5 billion rubles from the budget by a settlement agreement

Recall that one of the last affairs in which Rosneft was underway was the proceedings with the tax authorities about the compensation of VAT by 1.5 billion rubles, which was revealed that the Rosneft state-owned company was associated with the independent oil company (NNA) belonging to the former ex-President of Rosneft Eduard Khudainatov.

The Inspectorate of the Federal Tax Service N9, analyzing the case of " unlawful compensation for VAT from the budget", presented to the Moscow Arbitration Court evidence that Rosneft and NNK are "interdependent and affiliated" companies, are part of one group of companies and "have common commercial interest."

All this was revealed during the trial associated with the building of the NNA headquarters located in Moscow at Arbatskaya Square, house 1 (the building belongs to the "Zaeliko-Real Estate").

Numerous courts came to the conclusions that, firstly, the building in which the Khudaintov was located was acquired at the expense of Rosneft and its NPF Neftegarant, and secondly, a transaction for the sale of an elite object in the center of Moscow was concluded only for the return of 1.5 million VAT.

As Forbes wrote, as a result, the parties agreed on the amicable agreement: “Zaeliko-Real Estate” recognizes the inspection’s decision and does not require VAT compensation, and the tax authorities admit that “Zaeliko” is not interdependent to Rosneft and the persons affiliated with it, and NNA is not interdependent with Rosneft and the Rosneft and "Zaeliko".

To recognize such a settlement agreement, the court needed to cancel the decisions of lower courts. Thus, an attempt to borrow 1.5 billion rubles from the budget did not take place.
