Closed the case against the St. Petersburg architect who was accused of disrupting the shoulder strap from the policeman

Investigators have terminated the criminal case against the St. Petersburg architect Sergei Akhmetov , who was under arrest from last year to August due to an attack on a police officer while giving in support of Alexei Navalny in Moscow. In the summer, the man was released from a pre -trial detention center on a recognizance not to leave.

“The criminal case and criminal prosecution were terminated due to the expiration of the statute of limitations,” the lawyer of the architect Sergey Badamshin, who defend Akhmetov, told the Interfax agency as part of the Open Russia human rights project.

The defender added that the investigation re-qualified the accusation of Akhmetov from Article 318 of the Criminal Code of the Russian Federation (“Application of violence to a policeman”) to Article 319 of the Criminal Code of the Russian Federation (“Insulting a representative of power”) and terminated the proceedings due to the expiration of the statute of limitations. The lawyer noted that this is not a rehabilitating circumstance, saying that he will speak in more detail after familiarization with the decision. “Nevertheless, the main thing for us is that Sergei is free and the criminal prosecution of an innocent person has been discontinued,” Badamshin summed up.

In the summer, the representative of Open Russia Polina Nemirovskaya noted that the audit of Alibi Akhmetova lasted two months. “However, it was too difficult to close the case against an innocent person. Therefore, the first step was taken. Akhmetov, having spent eight months in custody, still leaves the pre -trial detention center and will now not live with 27 cellmates,” she said on August 9.

In the spring of this year, the lawyer of Haji Aliyev stated that Akhmetov was absent in the capital during the riots and was completely different from the person appearing on the video of the police. Most likely, investigators used the face recognition function on Facebook, not paying attention to the lack of similarity, then the lawyer suggested.

The architect was attracted as a suspect on the basis of a portrait forensic examination. At the same time, there were dark glasses on a person from the video, and an employee with experience of less than one year performed the examination itself, the defense notes. In addition, during the procedure for identifying a police officer who lost the shoulder strap during the acceleration of the gathering, they gave a hint.

According to investigators, Akhmetov specially came to Moscow to take part in the event. The lack of data on the purchase of air and railway tickets is explained by the fact that he could come with a bus or on a way. At the same time, as lawyers noted, closer to dinner on July 18, 2013, Akhmetov talked with one of the customers by phone. Billing data may confirm that he was in St. Petersburg and could not come to Moscow by the time the alleged detention.

In addition, the mother of the architect, who lives in Novosibirsk, provided evidence that at the time when the gathering took place, she talked with Sergey in Skype. According to her, he was in a home environment.

The criminal case on the fact of the use of violence against the commander of a separate battalion of the ATP of the Internal Affairs Directorate for the Central Administrative District of the Ministry of Internal Affairs in Moscow was instituted on July 20, 2013, two days after the national gathering in support of Navalny. On July 23, Colonel Pavlov was recognized as the victims in the case.

The investigation previously insisted that on the evening of July 18, opposite the house N2 on Tverskaya Street, Akhmetov did not allow the policeman to detain the woman, grabbed him by the shoulder strap and hurt his hand. Akhmetov, in turn, rejected all the charges and, together with the lawyer, stated that he had come to Moscow for the last time in 2011.

“I learned about the fact that I was on the border when I was traveling from vacation home to St. Petersburg. Then it turned out that I participated in Moscow in some kind of illegal actions. For me it was absurd,” the suspect said for the first time before the court. According to the architect, they took a man in a baseball cap and black glasses for him: "I have an artist's gaze. There is a man with a broken nose, he does not look like me at all."

Akhmetov was charged with the use of violence in relation to a representative of the authorities not dangerous to life and health (part 1 of Article 318 of the Criminal Code of the Russian Federation). The folk gathering, held in Moscow on July 18, 2013, was dedicated to Navalny’s sentence in the Kirovles case. Then the opposition was given five years in prison, and several thousand people went to the center of Moscow for a protest in his support. In the area of ​​Manezhnaya Square, at least 60 people were detained.
