Putin proposed to prohibit ignoring interpretations of the Constitutional Court
Russian President Vladimir Putin submitted to the State Duma a draft law banning the application of normative acts in an interpretation that is at odds with the interpretation of the Constitutional Court. The text of the bill is published on the website of the lower house of parliament.
The initiative involves the introduction of a new type of decision of the Constitutional Court - on the recognition of a normative act or its individual provisions as constitutional in the interpretation of the Constitutional Court. If such a decision is made, “any other interpretation” of the relevant normative act is excluded, the explanatory note to the bill says.
Appropriate regulation is expected to be established in relation to the decisions of the Constitutional Court on citizens' complaints about violations of constitutional rights and freedoms.
The bill provides, in particular, for tightening the wording of the article "Legal force of the decision" of the law on the Constitutional Court. The current wording of the article says that "the position of the Constitutional Court ... is subject to consideration by law enforcement authorities from the moment the relevant decision comes into force." The proposed wording states that “the courts, when considering cases after the entry into force of the decision […] are not entitled to be guided by a normative act or its individual provisions […] in an interpretation that is at odds with this Constitutional Court of the Russian Federation.”
The proposed changes are aimed at ensuring that law enforcement authorities take into account the positions of the Constitutional Court of the Russian Federation, which, within the framework of the current legal system, is a necessary element in maintaining the regime of law and order.
