"The decision of the Basmanny District Court on the election of a preventive measure in the form of house arrest in the form of house arrest before January 15, 2017 to leave a change in the appeal of lawyers Gridnev and Kashtanova - the judge said.
The meeting was held in the absence of Ulyukaev. The defense asked to change the measure of restraint for a recognizance not to leave. In addition, lawyers asked if the court considers it impossible to cancel house arrest, allow the ex-minister two-hour walks twice a day for health reasons. The defense reminded that Ulyukaev had minor children and elderly parents. They live separately, so they require a visit.
Lawyer Timofey Gridnev said in court that on November 14, Ulyukaev was detained on the exit from the Rosneft office illegally. “When leaving the Rosneft office, the car was blocked by the FSB officers. Then it was under the control of employees, he was forbidden to use the means of communication. In fact, Ulyukaev was detained, which implies its delivery to the bodies of inquiry or investigation, but the FSB officers ignored the rules,” the lawyer said. He emphasized that Ulyukaev at that moment was neither a suspect nor the accused, he had no procedural status.
Ulyukaev was under the control of the FSB officers until 23:30, all this time he was forbidden to go out or use a mobile phone anywhere, Gridnev recalled. The investigator Roman Nesterov in response stated that the rights of the former minister were not violated, and he summoned lawyers only after detention and interrogation.
Gridnev also stated that Ulyukaev wants to publicly express his position on the charges against him. "Our client considers it necessary to convey his point of view to the public. In this connection, we ask you to allow Ulyukaev to communicate with representatives of the media," the lawyer said. In the event that the court considers that this may interfere with the proceedings, the defense asks him to allow him one telephone interview with one of the media.
Judge Polyakova rejected all the defense petitions.
On the night of November 15, it became known that Ulyukaev was detained by the FSB . In the afternoon, Ulyukaev was charged under part 6 of Article 290 of the Criminal Code (receiving a bribe by civil servants on an especially large scale with extortion), which provides from 8 to 15 years in a fine of a fine of up to a 70-fold bribe, or without it. According to the plot of the case, the minister demanded from the representative of Rosneft Money for the legitimate issuance of a positive conclusion and evaluating "regarding the purchase by this company of the state stake of Bashneft. Otherwise, they say in the TFR, the official threatened to create obstacles to the work of Rosneft.
Meanwhile, the media reported that the Ulyukaev case was initiated by the head of the Rosneft Security Service Oleg Feoktistov, who until recently was the first deputy head of the FSB Office . It was argued that Feoktistov personally participated in "operational-technical events."
It was claimed that the FSB listened to the official of the official from the summer. Presidential spokesman Dmitry Peskov said that from the very beginning of the operational development of Ulyukaev, Vladimir Putin received all the information about the events, but did not dismiss the minister, because “sufficient reasons are necessary for dismissal,” rather than “primary information”.
The media reported that in the operational development of the FSB, in addition to Ulyukaev , there were a number of officials , in particular, Deputy Prime Minister Arkady Dvorkovich and Putin’s assistant Andrei Belousov. All of them, like Ulyukaev,, in one way or another, opposed the participation of Rosneft in the privatization of Bashneft.
Ulyukaev himself does not admit guilt. According to his lawyers, he regards the initiation of the case as a provocation. The official refuses to testify until the charge is specified and evidence is presented.
On November 15, in the evening, the Moscow Basmanny Court sent Ulyukaev under house arrest until mid -January. A few hours later, Putin dismissed the minister from his position "due to the loss of trust."
