Russian Railways tried to pretend the death of a track worker as a result of an accident in Transbaikalia [by Roskomnadzor] in order not to pay compensation, reports the East Siberian Transport Prosecutor's Office.
The incident occurred on June 25, 2014 at the 192nd kilometer of the Dosatui-Priargunsk section of the Trans-Baikal Railway. As the investigative check showed, the assembler Ch. “committed careless actions, violated labor safety instructions, as a result of which he was hit by a train.”
“However, despite the fact that this accident was related to production, the railway, in order to avoid material payments and compensation, refused to recognize it as such, did not comply with the relevant order of the State Labor Inspectorate for the Trans-Baikal Territory dated December 12, 2014, and appealed the decision in court investigative body, believing that the death of the track lineman was due to his committing suicide,” the prosecutor’s office reports.
The court did not accept the arguments of Russian Railways and at the end of 2015, the Borzinsky transport prosecutor filed a lawsuit in the Zabaikalsky District Court in favor of the mother of the deceased, since the death of the worker was not registered as an accident.
The district court supported the supervisory agency, Russian Railways unsuccessfully tried to appeal the decision in the Trans-Baikal Regional Court. It is reported that the Priargunsky District Court also satisfied the claim in favor of the parents of the deceased for compensation for the death of their son while working on the railway, which is a source of increased danger.
In January 2015, the Trans-Baikal Regional Court made a similar decision in favor of the mother and daughter of the deceased mechanic, who were awarded 800 thousand rubles.
